II PLANNING COMMISSION RESOLUTION NO. 1385 2 3 4 5 6 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A TENTATIVE MAP FOR THE FIRST PHASE OF EXPANSION INCLUDING THE REALIGNMENT OF BUENA VISTA CREEK AND THE ADDITION OF TWO MAJOR DEPARTMENT STORES AND ADDITIONAL MALL SHOPS. The subject application has complied with the requirement: of the Carlsbad Environmental Protection Ordinance of 197; because : a) An Environmental Impact Report (EIR-295 and 389) has been certified for this project. The proposed tentative tract map is consistent with appl: City public facilities policies and ordinances because: a) All necessary public facilities, including sewer serv: are available to serve the subject project as propose( NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio~ City of Carlsbad as follows: That the above recitations are true and correct. That in view of the findings heretofore made and consider. the applicable law, the decision of the Planning Commissic is to approve CT 76-18, subject to the following conditio: 1) The approval is granted for the land described in thl application and any attachments thereto and as shown on the plot plan submitted, labeled Exhibit A, B, an C, dated 6/17/77. 2) Those slopes located off-site, adjacent to the south of Marron Road and the tentative map boundary, shall landscaped and maintained for slope erosion control the applicant per the requirements of the Parks and Recreation Director. Maintenance of the benches alo those slopes shall be accomplished per this conditio 3) Necessary energy dissipating measures, such as rip-r or equivalent, shall be provided along the existing proposed alignment of the flood control channel as required by the City Engineer. 4) During grading and construction, all waste chemicals especially lubricants, paints and fuels, shall be pr contained and transported off the site where they ca recycled or destroyed. 5) Construction and grading equipment shall only be ser and washed at locations adequately equipped to dispo of wastes. .3 Ii .< .. :- i! 0 w 1 2 3 4 5 6 6) All facilities, such as storm drains and desiltation basins, necessary to minimize short-term and long-te~ adverse impacts on the water quality of Buena Vista Lagoon from project run-off shall be installed by tht applicant. The size, location, and design shall be i approved by the City Engineer. This condition implit the possibility of off-site facilities needed to mitigate previous and future actions by the develope] Maintenance of such off-site facilities would be by 1 City. 7 8 7) All grading and exterior construction activities sha: limited to the hours of 7:OO a.m. to 7:OO p.m. on Mol through Saturday. 9 10 11 12 13 14 15 8) The existing water main at the west end of the expan: area shall be extended southerly along the Monroe St: right-of-way to connect with the existing line near 1 Avenue, as required by the City Engineer. The appli( shall be reimbursed for costs of oversizing this watt main by others (reference is hereby made to the lettc from the City Manager to Nicholas Banche, dated Apri: 1976). 9) In order to meet minimum combined domestic and fire : requirements, a looped water system providing a minil of 5000 GPM shall be installed. All new buildings a: structures shall be so designed so as not to increast fire flow requirements of 4500 GPM. 16 17 10) Prior to final grading and paving of the parking lot applicant shall submit a parking lot plan to the Pla: Director for review and approval. I.8 I1 11) An additional fire hydrant shall be installed at the l9 I northwest corner of the site near the maintenance bu ing . 20 21 22 23 12) An additional 15' wide sewer easement shall be dedic to the City adjacent to the existing sewer easement. 13) The applicant shall relinquish access rights to Hap Drive, El Camino Real and Marron Road excepting driv access, as approved on the Precise Plan.
