" '. @ 9 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 1387 RESOLUTION OF THE PLANNING COMPlISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A FENCE EXCEEDING 6 FEET IN A FRONT YARD SETBACK (R-1 ZONE), UNDER SECTION 21.46.130 OF TITLE 21, LOCATED ON THE SOUTH SIDE OF ALMADEN LANE APPROXIMATELY 100 FEET NORTH OF THE INTERSECTION OF ZAMORA WAY IN LA COSTA. WHEREAS, a request for a certain property to wit: II Lots 191 and 192 of La Costa Valley Unit No. 5 8' 9 10 11 12 13 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said request constitutes a request as provided Section 21.46.130 of the "Carlsbad Municipal Code;" and WHEREAS, Planning Commission consideration was held on July 13, 1977; and 14 15 WHEREAS, at said consideration, the Commission consider( 16 17 18 19 20 21 22 23 24 all factors relating to the request and found the following facts and reasons to exist: 1) The location of the site in combination with the propose1 use and total project design create a situation that is unusual because: a) The site backs up to the La Costa Golf Course. b) The site consists of two adjacent lots. c) The location of the requested fence and use allowed right (tennis courts) will provide the most adequate separation of uses on site and off-site. d) The fence will be located adjacent to a single loade street . z5 2) The requested fence in combination with the use allowed 26 right (tennis court) create a circumstance not found in zones as a routine matter. 27 28 3) No adverse impacts will result in the neighborhood as a of granting the request because: *5 q 1) 1 2 3 4 5 6 7 a) Residences across the single loaded street are at a higher elevation and will not experience view blockac b) The landscaping is adequate to minimize any potentia. negative visual impacts. c) The fence will be set back from the roadway to insurc adequate sight distance. d) Adjacent residences or potential building areas are adequately removed from the fence location and will 1 be impacted visually. a NOW, THEREFOW, BE IT RESOLVED by the Planning Commissic 9 the City of Carlsbad as follows: 10 11 12 13 14 15 A) That the above recitations are true and correct.
