HomeMy WebLinkAbout1977-08-24; Planning Commission; Resolution 1398II w w 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1398 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A CONDITIONAL USE PERMIT FOR A CHURCH AND RELATED FACILITIES LOCATED ON THE SOUTHWEST CORNER OF ALGA ROAD AND EL FUERTE STREET. CASE NO: CUP-139 APPLICANT: JOHN MOCK WHEREAS, a verified application for certain property to wit: Lot 412, in the City of Carlsbad, County of San Diego, State of California, according to map thereof No. 6905 Assessor Book No. 215, Page 33, Parcel 01. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a requesl as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 24th day of August, 1977, hold a duly noticed public hearing as prescribe by law to consider said request: and WHEREAS, at said public hearing, upon hearing and con- sidering the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all factc relating to the Conditional Use Permit and found the followir facts and reasons to exist: 1) The requested use is necessary and desirable for the devt ment of the community, is essentially in harmony with thc various elements and objectives of the General Plan, and not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located because: a) There are no existing churches in this rapidly grow: area of the City. b) The General Plan recognizes the need and provides fc the location of this type of special use. .. . m w 1 2 3 4 2) 5 3) 6 7 8 9 10 11 12 13 14 15 4) 5) c) The proposed building design and landscaping will be compatible with surrounding multiple-family developme The site for the intended use is adequate in size and shal to accommodate the use because: a) The five acre site provides adequate area for expans: All yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existinc or permanent future uses in the neighborhood will be prov. and maintained because: a) They are required as conditions of approval. The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use because: a) The site is surrounded by public streets; Alga Road a major arterial, El Fuerte Street is a secondary arterial, and Alfanje Street is a local street. The subject application has complied with the requirement the Carlsbad Environmental Protection Ordinance of 1972 because: a) A negative declaration has been issued for the propo project. 16 17 18 19 20 21 22 23 24 25 26 27 28 6) The subject application is consistent with applicable Cit Public Facilities Policies and Ordinances because: a) A letter was received on June 15, 1977 from the Leuc County Water District stating sewer service was avai at that time. Conditions of approval require a vali sewer connection permit prior to construction. NOW, THEREFORE, BE IT resolved by the Planning Commissic the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and considel the applicable law, the decision of the Planning Commissj is to approve the (CUP-139), subject to the following conditions: 1) Prior to the issuance of building permis for the first pl the applicant shall provide to the City one-fourth (%) oj the cost of a future traffic signal to be located at the corner of Alga Road and El Fuerte Street. If the City Cc has adopted a traffic signal ordinance prior to the abovt date, the applicant shall comply with the provisions of ! ordinance in lieu of the above condition. The location of t buildings, parking, landscaping, and other facilities sha. be located substantially as shown on the plot plan except provided otherwise herein. 4) Prior to the issuance of building permits for each phase, applicant shall submit a landscape and irrigation plan to Parks and Recreation Director for review and approval. T approved plan shall reflect current City Policy regarding water conservation. 5) Phasing shall be permitted as shown on Exhibit "A", dated August 8, 1977. 6) Signing shall be limited to signs as shown on Exhibit "A" dated August 8, 1977. 7) Prior to the issuance of building permits for any phase, applicant shall present a current sewer connection permit or septic system permit to the Building Department. 8) The applicant shall dedicate vehicular access rights to t City along Alga Road and El Fuerte Street prior to the issuance of building permits. 9) Prior to the issuance of grading permits, the applicant s propose a method of general maintenance, erosion control trash pick-up for phases two (2) through four (4) to the satisfaction of the City Engineer. 2o 21 10) The applicant shall utilize energy and water conservatior measures, such as drip irrigation, low-flow toilets and 22 faucets, florescent lighting, etc., wherever determined 23 feasible by the Building Director. 24 PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on August 24, 1977, 25 26 27 28 the following vote to wit: xxx xxx xxx .3 ,.
