HomeMy WebLinkAbout1977-08-24; Planning Commission; Resolution 1401L :-h W I~ i 1 2 3 4 5 6 7 8 9 LO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2% PLANNING COMMISSION RESOLUTION NO. 1401 RESOLUTION OF THE PLANNING COMJKCSSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A CONDITIONAL USE PERMIT TO ALLOW A RETAIL NURSERY TO BE LOCATED IN A C-2 ZONE ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF PALOMAR AIRPORT ROAD EAST OF PLAZA DEL NORTE. CASE NO: CUP-141 APPLICANT: ROBERT COLBURN WHEREAS, a verified application for certain property to wit: Portion of Lot H of Rancho Agua Hedionda, recorded on Map 823, San Diego County Office in the City of Carlsbad County of San Diego, State of California has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 24th day of August, 1977, hold a duly noticed public hearing as prescribe by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consid the testimony and arguments, if any, of all persons who desir to be heard, said Commission considered all factors relating the Conditional Use Permit and found the following facts and reasons to exist: 1) The requested use is necessary and desirable for the deve ment of the community, and is essentially in harmony witk the various elements and objectives of the General Plan, is not detrimental to existing uses or to uses specifical permitted in the zone in which the proposed use is to be located because: a) The proposed use will be located in an area that cont established commercial uses, and will provide a logic extension of these facilities. i - .-4 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I 1 w b) The proposed use, by fulfillment of the CUP findings, meets the intent of the General Plan Land Use Element regarding unique and special uses. 2) The site for the intended use is adequate in size and sha to accommodate the use because: a) Proposed building location, design and customer parki circulation are provided in an efficient manner relat to lot configuration. 3) All yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existin or permanent future uses in the neighborhood will be prov and maintained because: a) The proposed site is adjacent to established commerci and governmental uses and also adjacent to property planned for other non-residential uses. b) A minimum of 10' will be maintained between structure and property lines which will provide adequate separz from adjacent uses. 4) The street system serving the proposed use is adequate tc properly handle all traffic generated by the proposed USE because : a) The proposed site is adjacent to a prime arterial st1 which is adequate to handle any traffic generated. 5) The subject application has complied with the requirement the Carlsbad Environmental Protection Ordinance of 1972 because: a) A Negative Declaration was issued for the subject prc 6) The subject application is consistent with applicable Cii Public Facilities Policies and Ordinances because: a) No additional sewer connections are required with th: project and all other public facilities and services available. NOW, THEREFORE, BE IT resolved by the Planning Commissic of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and conside the applicable law, the decision of the Planning Commiss to approve the retail nursery, subject to the following conditions: .2 * It ..h w m 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 l? 18 19 20 21 22 23 24 25 26 27 28 id 6' 1) Approval is granted for the land described in the applica and attachments thereto, and as shown on the plot plan, Exhibit A, dated 8/15/77. The location of all buildings other facilities shall be located substantially as shown on the plot plan except as indicated otherwise herein. 2) A minimum 3' clear space shall be provided between the dr ways and the easterly and westerly property lines. 3) The landscape and irrigation plan as shown on sheet 2 of Exhibit A is hereby approved. All landscaping shall be i stalled prior to final occupancy. 4) "Dry" sewer lines shall be installed per the requirements the City Engineer. The use of a septic system shall only permitted until adequate plan capacity becomes available. 5) Adequate directional signing for the one-way drives shall provided per the requirements of the City Engineer. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on August 24, 1977 the following vote, to wit: AYES: Commissioner Larson, Rombotis, L'Heureux, Wat Fikes, Jose, Woodward.
