HomeMy WebLinkAbout1977-09-28; Planning Commission; Resolution 1402.- :- - 3 It w w v- r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 /I PLANNING COMMISSION RESOLUTION NO. 1402 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE APPEAL OF THE NEGATIVE DECLARATION ISSUED BY THE PLANNING DIRECTOR REGARDING THE CITY OF CARLSBAD'S FIRST PHASE SEWER ALLOCATION SYSTEM. APPELLANT : KAISER-AETNA WHEREAS, an appeal of determination of declaration of negative environmental effect regarding the First Phase Sewer Allocation System of the City of Carlsbad has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified appeal constitutes a request as provided by Title 19 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 28th day of September, 1977, hold a duly noticed public hearing as prescr by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consid testimony and arguments, if any, of all persons who desired t heard, said Commission considered all factors relating to the appeal, and found the following facts and reasons to exist to deny the appeal and uphold the negative declaration as issued the Planning Director for the following reasons: 1) There will only be 270 sewer permits granted in this First Phase Allocation, a very insignificant amount. The amount itself would have a very small impact on the environment. In addition, these permits can on1 be granted to projects that have previously met the Carlsbad Environmental Ordinance and all discretiona actions have been completed. 2) The system will promote development in the already urbanized part of the City or permit commercial and industrial development in areas already zoned for such uses. The system will also discourage developzr in outlying areas that would disrupt the environment I.~ , -. -, 'I ll 1 2 3 W W and cause additional services to be provided. On the other hand, the impacts of development in the urbanized area will be insignificant because there are not that many permits to be issued. 4 5 6 7 8 3) The distribution of permits,will approximately be 80 residential units in the urbanized area and 125 com- mercial and industrial permits in areas already zoned for such uses. Nost of this development will occur in the already urbanized area which is an area of approximately 3800 acres. If all the permits were given in this area it would average out as one permit for every 15 acres. For residential, it would be one for every 47 acres. This is a very insignificant img on this already urbanized area. 9 10 11 4) The system may promote developments that are designed with energy and water conserving techniques, encourag development near existing schools, parks, transportat systems, fire station, and discourage projects that require additional public costs. 12 l3 16 B) That in view of the findings heretofore made and consideri l5 A) That the above recitations are true and correct.
