HomeMy WebLinkAbout1977-09-28; Planning Commission; Resolution 1404‘1 d L .d u- mu 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 i 27 I PLANNING COMMISSION RESOLUTION NO. 1404 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A ZONE CHANGE FROM OPEN SPACE (0-S) TO INDUSTRIAL (M) ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL BETWEEN SUNNY CREEK ROAD AND PALOMAR AIRPORT ROAD. CASE NO: ZC-197 APPLICANT: COUNTY OF SAN DIEGO WHEREAS, a verified application for certain property to wit: Lots A and B of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California according to Map thereof No. 823, filed in the office of the County of San Diego County, November 16, 1896 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 28th day of September, 1977, hold a duly noticed public hearing as prescr: by law to consider said request: and WHEREAS, at said public hearing, upon hearing and con- sidering the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all facto ~ relating to the zone change and found the following facts and ~ reasons to exist: 1) The proposed zone change is consistent with the General P because : a) The change would bring the zoning on the property int conformance with the General Plan Amendment which the Planning Commission recently recommended for approval 2) The subject application has complied with the Carlsbad Environmental Protection Ordinance of 1972 because: 28 6' b w- W- II 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 i 20 21 22 23 24 25 26 27 28 ~ a) An EIR has been prepared by the County and has been certified by the Board of Supervisors. b) The Planning Commission has, as a Responsible Agency under CEQA, considered the certified EIR for the project. 3) The proposed zone change is consistent with the applicab City Public Facilities Policies and Ordinances because: a) The project complies with the sewer allocation ordin which allows capacity for government facilities. Th county is also considering alternative disposal meth b) Staff has received assurances from all other affecte agencies that public facilities will be available to serve the property. NOW, THEREFORE, BE IT resolved by the Planning Commissio of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi to approve Zone Change 197. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on September 28, 19 by the following vote, to wit: AYES: Commissioner, Larson, Rombotis, Woodward Wats NOES : Commissioner, L'Heureux, Fikes ABSENT: Commissioner, Jose.
