CASE NO: CUP-142 APPLICANT: DENNIS DASSOF THE P-M ZONE ON PROPERTY GENERALLY LOCATED ON 8 I1 WHEREAS, a verified application for Certain property to 911 wit: 10 11 12 13 14 15 16 17 That portion of Lot "G" of Rancho Agua Hedionda in the County of San Diego, State of California, according to map thereof No. 823, filed in the Office of County Recorder of San Diego County, November 16, 1896 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a requesl as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 26th day of I 18 19 October, 1977, hold a duly noticed public hearing as prescril by law to consider said request; and 20 II WHEREAS, at said public hearing, upon hearing and con- 21 22 23 sidering the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all facts relating to the Conditional Use Permit (CUP-142) and found t 24 25 P-M Zone because: 26 a) The P-M Zone permits only commercial uses that are f 27 following facts and reasons to exist: 1) The requested use is not consistent with the intent of t the convenience of occupants of the P-M Zone. 28 b) The proposed use is not oriented to the occupants of this industrial zone. ' i .S.C /I w - 1 2) The requested use is detrimental to existing uses or to u specifically permitted in the zone in which the proposed 2 is to be located because: 3 4 5 a) Security will be made more difficult with the intrusi of customers in off-hour times. b) The existing development does not have sufficient par for commercial type uses. t5 7 3) The requested use is not consistent with the General Plar 8 because : a) The General Plan indicates that industrial area shoul protected from encroachment of non-industrial uses. 9 NOW, THEREFORE, BE IT resolved by the Planning Commissi( lo A) That the above recitations are true and correct. Ill. of the City of Carlsbad as follows: 12 13 14 15 16 17 18 19 B) That the action of the Planning Commission is to DENY Conditional Use Permit Request No. CUP-142, on property located on the west side of of Yarrow Drive between Cami~ Vida Roble and Palomar Airport Road. PASSED, APPROVED AND ADOPTED at a regular meeting of thc City of Carlsbad Planning Commission held on October 26, 197' by the following vote, to wit: AYES: Commissioner, Larson, Rombotis, Jose, Woodward.
