HomeMy WebLinkAbout1977-12-14; Planning Commission; Resolution 1422w W 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I I PLANNING COWIISSION RESOLUTION NO. 1422 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A CONDITIONAL USE PERMIT REQUEST TO PERMIT A PUBLIC USE ON A TRANSMITTING TOWER, ON PROPERTY LOCATED ON THE EAST SIDE OF EL CAMINO REAL, BETWEEN PALOMAR AIRPORT ROAD AND TAMARACK AVENUE. CASE NO: CUP-144 APPLICANT: CITY OF CARLSBAD WHEREAS, a verified application for certain property to wit: That portion of Lot C located in RHO Agua Hedionda County of San Diego, State of California, according to Map 823 and as listed on the San Diego County, Assessor's Map Book 169, Page 23 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reques- as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 9th day of November, 1977, hold a duly noticed public hearing as prescr: by law to consider said request; and I I ~ WHEREAS, at said public hearing, upon hearing and consic the testimony and arguments, if any, of all persons who desi] to be heard, said Commission considered all factors relating the requested Conditional Use Permit (CUP-144) and found the ~ following facts and reasons to exist: ~ 1) The requested use is necessary and desirable for the devc ment of the community, is essentially in harmony with thc various elements and objectives of the General Plan, and not detrimental to existing uses or to uses specifically mitt& in the zone in which the proposed use is to be lo( because: a) The elevation of this site, along with location, in approximate geographic center of Carlsbad, will give proper transmitting to the entire City. 11 W 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 b) Because of the hilly terrain and relative great dis to the surrounding properties, the use will have ve little visual impact on the area. 2) The site for the intended use is adequate in size and shi to accommodate the use because: a) The use will occupy a very small space towards the portion of the lot towards the north east corner of this large lot, therefore, there will be very littlt impact to the surrounding areas. 3) All yards, setbacks, walls, fences, landscaping and othe: features necessary to adjust the requested use to existir or permanent future uses in the neighborhood will be pro7 and maintained because: a) The location of the use meets all of the code requil ments. 4) The street system serving the proposed use is adequate t( properly handle all traffic generated by the proposed USC because: a) There will be no traffic generated by this use. 5) The subject application has complied with the requirement of the Carlsbad Environmental Protection Ordinance of 195 because : a) A Negative Declaration was issued because: The mour terrain surrounding the project reduces the towers ~i impact on surrounding residential areas. The tower conjunction with existing public services and there be no significant grading or disturbances of vegetat 6) The subject application is consistent with applicable Cit Public Facilities Policies and Ordinances because: a) The project will have no demand on the public servic facilities. NOW, THEREFORE, BE IT resolved by the Planning Commissio: of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi~ is to approve eU7.P-144, subject to the following condition: 1) Approval is granted for the land described in the applicat and attachments thereto, and as shown on the plot plan SUI mitted labeled Exhibit "A'', dated 9/29/77. I/ -2- - w 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 2) If the use or transmitting causes disturbances to the ne: University of California research facility, the applicani shall submit to the Planning Commission methods to mitigi the disturbance. The method the Planning Commission fee: to be appropriate shall then be installed in a time peric determined by the Planning Commission. If the Planning Commission is dissatisfied with the mitigating measures ( results thereof, the Planning Commission shall request CI to be noticed for public hearing to determine extent of problem and possible solutions. PASSED, APPROVED AND ADOPTED at a regular meeting of tht City of Carlsbad Planning Commission held on December 14, 19' by the following vote, to wit: AYES: Commissioner Jose, Rombotis, Woodward, Larson, Fikes, L'Heureux.
