RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A
REQUEST TO PERPTIT A GREENHOUSE IN THE PC ZONE
ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL, NORTH OF THE LAGOON.
CASE NO: CUP-145
APPLICANT: BRUCE SMITH
WHEREAS, a verified application for certain property to
wit:
Lot 2 in Section 35, Township 12 South, Range 4 West,
in the County of San Dieqo, State of Czlifornia. according to-United States. Government Survey, approved
May 3, 1883
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a reques.
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 9th day of
November, 1977, hold a duly noticed public hearing as prescr.
by law to consider said request: and
WHEREAS, at said public hearing, upon hearing and consic

to be heard, said Commission considered all factors relatinc
the Conditional Use Permit (CUP-145) and found the following
facts and reasons to exist:
1) The requested use is necessary and desirable for the dev.
elopment of the community, is essentially in harmony wit1
the various elements and objectives of the General Plan,
is not detrimental to existing uses or to uses specifica. permitted in the zone in which the proposed use is to be
located because:
a) The greenhouse will not be seen from nearby residen. uses and the distance from public right-of-way is relatively great.
2) The site for the intended use is adequate in size and shl
accommodate the use because:

a) The property that contains the greenhouse site is la
and therefore gives adequate buffer between adjacent
properties.
b) Encouraging agricultural uses preserve open spaces,
reduce service demands, and provide employment.
3) All yards, setbacks, walls, fences, landscaping and other
features necessary to adjust the requested use to existin
or permanent future uses in the neighborhood will be prov
and maintained because:
7 a) All setbacks will be met by the project.
8 4) The street system serving the proposed use is adequate to
9 handle all traffic generated by the proposed use because:

11 5) The subject application has complied with the requirement
the Carlsbad Environmental Protection Ordinance of 1972 12 because:

a) A Negative Declaration was issued for the project be

6) The subject application is consistent with applicable Cit
Public Facilities Policies and Ordinances because:
a) There is no demand on public services created by thi
project .
NOW, THEREFORE, BE IT resolved by the Planning Commissio
of the City of Carlsbad as follows:
A) That the above recitations are true and correct.
B) That in view of the findings heretofore made and consider
the applicable law, the decision of the Planning Commissi
is to approve the Conditional Use Permit (CUP-145), subje
to the following conditions:
1) The approval is granted for the land described on the plo plan Exhibit "A", dated October 13, 1977.
2) If the approved greenhouse is abandoned and/or no longer
longer than 6 months, it will be removed from the site wi 90 days.
3) This permit shall be valid for 5 years. At the end of th
first five year period the applicant may submit a letter

the Planning Commission requesting an extension for an
additional five year period, then tile Commission will revi
the CUP and the conditions, and may extend it for an addit
five years, based on such terms and conditions that they n
desire. If the Planning Commission does not wish to grant
an extension, the CUP shall be terminated.
4) Access to the greenhouse shall be in compliance with the I
I Marshall.
5) Noise, odor, dust and pesticides shall be controlled so as
to cause a detrimental effect to the surrounding propertie
and ground water run-off will be to the satisfaction of th
City Engineer.
6) Trees for screening shall be planted along the east and sc
sides of the greenhouse. A landscape plan for such planti
shall be to the satisfaction of the Parks and Recreation
Director.
