HomeMy WebLinkAbout1978-01-11; Planning Commission; Resolution 1426li w w 1 PLANNING COMMISSION RESOLUTION NO. 1426 2 3 4 5 6 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION AND OPERATION OF A CHURCH IN THE R-1 ZONE ON PROPERTY GENERALLY LOCATED ON THE SOUTH WEST CORNER OF CHESTNUT AND MONROE. CASE NO: APPLICANT : OTTO KORVER ~ CUP-146 7 I1 WHEREAS, a verified application for certain property to 8 9 10 11 12 13 14 l5 ~ 16 wit: That portion of Tract 250 of the Thum Lands, in the Citl of Carlsbad, County of San Diego, State of California, according to Map thereof No. 1681, filed in the office of the County Recorder of San Diego County, December 9, 1915 has been filed with the City of Carlsbad and referred to the Planning Commission: and WHEREAS, said verified application constitutes a request I as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 14th day of December, 1977, hold a duly noticed public hearing as prescr: by law to consider said request; and 17 18 19 20 21 22 23 24 25 WHEREAS, at said public hearing, upon hearing and consic ing the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all factors relating to the Conditional Use Permit (CUP-146) and found tl following facts and reasons to exist: 1) The requested use is essentially in harmony with the var. elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically per1 in the zone in which the proposed use is to be located bl 26 27 a) The General Plan recognizes the need and provides fo. the location of this type of Specla1 use. 28 w W 1 b) The proposed building design, parking and landscaping will be compatible with the surrounding single-family 2 development. 3 4 2) The site for the intended use is adequate in size and sha the facility and required parking. 5 to accommodate the use because: a) The three acre site is adequate in size to accommodat 6 7 8 9 10 11 3) All yards, setbacks, walls, fences, landscaping and otheY features necessary to adjust the requested use to existir or permanent future uses in the neighborhood will be pro1 and maintained because: a) There is adequate separation between the building ant existing residential use for proper protection, noisc and other nuisances. b) The 6 ft., high masonry wall will give added protectj to the surrounding uses. 12 4) The street system serving the proposed use is adequate tc properly handle all traffic generated by the proposed USC 13 because: 14 a) Chestnut and Monroe Street are both collector street! 15 19 a) A Negative Declaration has been issued for the propor 18 because: 17 5) The subject application has complied with the requiremeni 16 anticipated traffic to the site. with adequate width and capabilities to handle the the Carlsbad Environmental Protection Ordinance of 1972 project. 6) The subject application is consistent with applicable Ci. 2o I Public Facilities Policies and Ordinances because: 21 22 23 a) The first phase allocation system reserves capacity : community facilities such as churches. b) Half-street improvements are required on Chestnut, Magnolia, and Monroe as part of this approval. 24 A) That the above recitations are true and correct. 27 of the City of Carlsbad as follows: 26 NOW, THEREFORE, BE IT resolved by the Planning Commissi 25 c) All other public facilities are existing or can be m 28 2. I/ I1 w w I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning cornissic to approve the Conditional Use Permit, subject to the following conditions: 1) Approval is granted for the land described in the applica and with the attachments thereto, and as shown on the plo plan submitted, labeled Exhibit "A1' , dated, October 27, 1 and activities similar to those submitted in the letter f Mr. Korver dated November 4, 1977. Location of all build parking, landscaping and other facilities shall be locate substantially as shown on the plot plan, except as provii? herein. 2) The tower, as indicated on Exhibit "A1' is approved as shc on Exhibit "B" , dated December 6, 1977, except that the p shall not be placed on the tower. The total height of tk tower shall not exceed 58 ft., 10 inches. The height of tower shall be measured starting from the finished floor of the church. 3) The plans shall contain a trash pick-up area. The locatj and construction of such trash pick-up area shall be to t satisfaction of the Planning D,irector. 4) The northerly driveway along Monroe shall be shifted at I 50 ft., to the south, and the parking stalls north of the driveway shall either be eliminated or proper turnaround be provided so that all vehicles will exist in a forward manner . 5) A removable barrier shall be placed across the accesses Magnolia and Chestnut at all times when the church facil are not being used. This barrier shall consist of metal poles, or similar materials to the satisfaction of the Planning Director and Fire Marshall. Speed bumps shall ' installed to slow down traffic within the parking lot. 6) The location of handicapped parking spaces shall be prov to the satisfaction of the City Engineer. 7) The applicant shall dedicate an additional right-of-way the frontage of Chestnut Avenue on the basis of a 68 foo right-of-way. The right-of-way dedication shall include property line return with a radius of 20 feet. 8) The applicant shall improve the half street improvement Monroe Street on the basis of 60 foot street section. 7 sidewalk location at Monroe Street as shown on the site shall be contiguous with the curb per City standards. 9) The applicant shall improve 30 feet half street improven along the frontage of Magnolia Avenue. 10) The applicant shall construct a wheelchair ramp at the c return. 3. Street trees shall be provided on Chestnut, Monroe, and Magnolia, to the satisfaction of the Parks and Recreation Director. Landscaping and irrigation plans shall be submitted, prio building permits and to the satisfaction of the Director Parks and Recreation. Landscaping shall be drought resis and irrigation systems shall contain automatic timing dev for water conservation. Interior and exterior energy and water saving devices sha be required to the satisfaction of the City Engineer and Building Official. In order to provide for reasonable fire protection durinc the construction period, the applicant shall maintain possible vehicular access to all buildings. Interior lighting shall be shielded' from the adjacent residences. 19 20 21 22 23 24 25 20) The proposed expanded parking area along Magnolia as shot on Exhibit A is approved per this action. However, fina: development plans are to be to the satisfaction of the Planning Director and City Engineer. The plans shall in( landscaping, a 6' high masonry wall, similar to the wall that is proposed for the rest of the site, along all interior property lines separating parking areas from adjacent residences.
