RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT FOR THE CONSTRUCTION
AND OPERATION OF A CHURCH IN THE R-1 ZONE ON
PROPERTY GENERALLY LOCATED ON THE SOUTH WEST
CORNER OF CHESTNUT AND MONROE.

That portion of Tract 250 of the Thum Lands, in the Citl
of Carlsbad, County of San Diego, State of California,
according to Map thereof No. 1681, filed in the office
of the County Recorder of San Diego County, December 9,
1915
has been filed with the City of Carlsbad and referred to the
Planning Commission: and
WHEREAS, said verified application constitutes a request
I as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 14th day of
December, 1977, hold a duly noticed public hearing as prescr:
by law to consider said request; and

WHEREAS, at said public hearing, upon hearing and consic
ing the testimony and arguments, if any, of all persons who
desired to be heard, said Commission considered all factors
relating to the Conditional Use Permit (CUP-146) and found tl
following facts and reasons to exist:
1) The requested use is essentially in harmony with the var.
elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically per1 in the zone in which the proposed use is to be located bl

B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning cornissic
to approve the Conditional Use Permit, subject to the
following conditions:
1) Approval is granted for the land described in the applica
and with the attachments thereto, and as shown on the plo
plan submitted, labeled Exhibit "A1' , dated, October 27, 1
and activities similar to those submitted in the letter f

parking, landscaping and other facilities shall be locate
substantially as shown on the plot plan, except as provii? herein.
2) The tower, as indicated on Exhibit "A1' is approved as shc
on Exhibit "B" , dated December 6, 1977, except that the p
shall not be placed on the tower. The total height of tk
tower shall not exceed 58 ft., 10 inches. The height of
tower shall be measured starting from the finished floor
of the church.
3) The plans shall contain a trash pick-up area. The locatj
and construction of such trash pick-up area shall be to t
satisfaction of the Planning D,irector.
4) The northerly driveway along Monroe shall be shifted at I
50 ft., to the south, and the parking stalls north of the
driveway shall either be eliminated or proper turnaround
be provided so that all vehicles will exist in a forward
manner .
5) A removable barrier shall be placed across the accesses
Magnolia and Chestnut at all times when the church facil
are not being used. This barrier shall consist of metal
poles, or similar materials to the satisfaction of the
Planning Director and Fire Marshall. Speed bumps shall '
installed to slow down traffic within the parking lot.
6) The location of handicapped parking spaces shall be prov
to the satisfaction of the City Engineer.
7) The applicant shall dedicate an additional right-of-way
the frontage of Chestnut Avenue on the basis of a 68 foo
right-of-way. The right-of-way dedication shall include
property line return with a radius of 20 feet.
8) The applicant shall improve the half street improvement
Monroe Street on the basis of 60 foot street section. 7

The fire hydrant requirements shall be approved by the Fi

Street trees shall be provided on Chestnut, Monroe, and
Magnolia, to the satisfaction of the Parks and Recreation Director.
Landscaping and irrigation plans shall be submitted, prio
building permits and to the satisfaction of the Director
Parks and Recreation. Landscaping shall be drought resis
and irrigation systems shall contain automatic timing dev for water conservation.
Interior and exterior energy and water saving devices sha
be required to the satisfaction of the City Engineer and
Building Official.
In order to provide for reasonable fire protection durinc
the construction period, the applicant shall maintain
possible vehicular access to all buildings.
Interior lighting shall be shielded' from the adjacent
residences.

20) The proposed expanded parking area along Magnolia as shot on Exhibit A is approved per this action. However, fina:
development plans are to be to the satisfaction of the
Planning Director and City Engineer. The plans shall in(
landscaping, a 6' high masonry wall, similar to the wall
that is proposed for the rest of the site, along all
interior property lines separating parking areas from
adjacent residences.

City of Carlsbad Planning Commission held on January 11, 1978
