HomeMy WebLinkAbout1978-01-11; Planning Commission; Resolution 14293;- li . e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO- 1429 RESOLC'TION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 9 TO ALLOW A TEMPORARY TRAILER FOR USE AS AN EMPLOYEE LUNCHROOM UNTIL A PERMANENT STRUCTURE CAN BE BUILT ON PROPERTY GENERALLY LOCATED BETWEEN HAYMAR DRIVE AND COLLEGE BOULEVARD. CASE NO: CUP-9 (A) APPLICANT: SOUTH COAST ASPHALT WHEREAS, a verified application for certain property to wit: The portion of Rancho Agua Hedionda, in the City of Carlsbad, in the County of San Diego, State of Californj according to Partition Map No. 823, filed in the office of the County Recorder of San Diego County, November 16, 1896, as more particularly set out in the complete legal description on file in the City of Carlsbad Planning Department has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a requesi as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 14th day of December, 1977, hold a duly noticed public hearing as prescr: by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consic the testimony and arguments, if any, of all persons who desil to be heard, said Commission considered all factors relating the Conditional Use Permit (CUP-9 (A), and found the followinc facts and reasons to exist: 1) The requested use is essentially in harmony with the var elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically per] in the zone in which the proposed use is to be located because: a) The mobile unit cannot readily be seen from public a: 4 .. t s. * '- I1 e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 b) The mobile unit will be removed as required by the ZC code. 2) The site for the intended use is adequate in size and shz to accommodate the use because: a) The subject site is 52 acres and therefore it can ea! accommodate this mobile unit. 3) All yards, setbacks, walls, fences, landscaping, and otht features necessary to adjust the requested use to existi] or permanent future uses in the neighborhood will be pro1 and maintained because: a) The mobile unit is inside the property away from pub: streets or surrounding properties. 4) The street system serving the proposed use is adequate tc properly handle all traffic generated by the proposed us( because : a) The approval of this CUP will have no effect on the street systems ability to handle traffic and access 7 it is by private drive. 5) The subject application has complied with the requiremen- of the Carlsbad Environmental Protection Ordinance of 19' because: a) The project will not affect the vegetation or wildli: in the area since it has been previously graded; and trailer is located in an existing quarry site, and w: have no significant impact in the area. 6) The subject application is consistent with applicable Ci- Public Facilities Policies and Ordinances because: a) The requested use for a temporary trailer will not p. added demands on the services existing on the site. NOW, THEREFORE, BE IT resolved by the Planning Cornissic of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and conside: the applicable law, the decision of the Planning Commiss. is to approve the Conditional Use Permit (CUP-9(A), subjc to the following conditions: 1) Approval is granted for the land described in the applic; and attachments thereto, and as shown on the plot plan labeled Exhibit "A", dated December 6, 1978, e2 4 . PASSED, APPROVED AND ADOPTED at a regular meeting of tht City of Carlsbad Planning Commission held on January 11, 197i by the following vote, to wit: 10 11 12 13 14 15 16 17 AYES : NOES : Commissioner Woodward, Jose, Larson, Fike, Rombotis.
