CASE NO: ZC-185 APPLICANT : ROBERT SONNEBORN ZONE CmVGE FROM COUNTY A-1- (8) TO L-C (LIMITED I1 WHEREAS, a verified application for a certain property as shown on t 7 I1 attached map, has been filed with the City of Carlsbad and referred to tk 8 11 Planning Commission; and 9 10 11 12 13 14 15 16 WHEREAS, said verified application constitutes a request as providec by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 25th day of January, 19i hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering the tc imony and arguments, if any, of all persons who desired to be heard, saic Commission considered all factors relating to the Zone Change (ZC-lSS), 2 found the following facts and reasons to exist: 1) The L-C Zone is appropriate for this property for the following reast 17 18 19 2o ll a) The zone is a holding zone which will not preclude options to tht applicant or the City in the future. 21 b) The L-C Zone will permit the applicant to initiate preceedings fc annexation to the City. 22 c) The L-C Zone would have no adverse effects or impacts on the are: 23 the property. 24 25 2) The proposed zone change is consistent with the General Plan because 27 26 a) The L-C Zone is a holding zone that only permits agricultural us( 28 and uses presently on the property. b) The L-C Zone does not exclude future options to the City. xxx I1 W w 1 3) The proposed zone change complies with the requirements of the Carlsb Environmental Protection Ordinance of 1972, because Environmental Imp 2 Report No. 352 has been certified for the following reasons: 3 4 5 a) The Environmental Impact Report sufficiently provides data to determine proper zoning of the property. b) The Environmental Impact Report sufficiently describes the physic characteristics of the property. 6 7 c) The Environmental Impact Report sufficiently explains impacts up0 Facilities Policy and Ordinance because: 8 the property and surrounding areas. 4) The proposed zone change is consistent with the applicable City Publi 9 10 11 12 13 14 15 a) There will be no added demand for public facilit-ies caused by thi change of zone to the L-C holding zone. NOW, THEREFORE, BE IT resolved by the Planning Commission of the Ci? of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and considering the appl law, the decision of the Planning Commission is to APPROVE ZC-185 loc 2,000 feet east of El Camino Real, and 4,000 feet nm Palomar Ai Road. 16 Planning Commission held on January 25, 1978, by the following vote, to w 17 PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Car None.
