HomeMy WebLinkAbout1978-03-22; Planning Commission; Resolution 1439a 0 1 2 3 4 5 PLANNING COPJTISS'ION RESOLUTION NO. 1439 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A ZONE CHANGE FROM "MI' INDUSTRIAL TO "M-Q" INDUSTRIAL - QUALIFIED OVERLAY ON PROPERTY LOCATED ON THE EAST SIDE OF EL CAMINO REAL, NORTH OF PALOMAR AIRPORT ROAD. CASE NO: ZC-198 APPLICANT : CITY OF CARLSBAD 6 7 WHEREAS, a verified application for certain property to a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 wit: (As per the attached Exhibit "A" dated has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reques. as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Cornmission did on the 22nd day of March, 1978, hold a duly noticed public hearing as prescribec law to consider said request; and WHEREAS, at said public hearing, upon hearing and consic the testimony and arguments, if any, of all persons who desi: to be heard, said Commission considered all factors relating the Zone Change (ZC-198) and found the following facts and ri to exist: 1) The addition of the Qualified Overlay Zone to the reques M Zone will assure, through the site development plan ap: process, that the following factors will be considered p to development : a) The subject area is zoned M and is adjoined by large single family residential zoning and within the view of another area now in the process of being planned large lot, single family dwelling. b) The subject area contains highly varied topography, 27 2) The proposed zone change is consistent with the General 28 areas of native vegetation, and some flood plain. because: li /I 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 a) Application of the Q Overlay zone is appropriate bee the subject area is identified as a "special treatmt area" in the General Plan. b) The subject area is adjacent to El Camino Real, whic a major north/south traffic corridor, and is listed the General Plan as being eligible for the designat: "scenic highway. " c) The General Plan identifies the area as being withil "Palomar Airport Impact Area. " 3. The proposed zone change complies with the requirements ( Carlsbad Environmental Protection Ordinance of 1972 becal a Negative Declaration has been issued for the following reasons: a) The project is consistent with the Carlsbad General 1 since the property is identified as a Special Treatml Area. b) The project presents additional regulations on develc that will further insure environmental protection. c) The Q overlay will not affect the use of the subject property, but instead directs itself primarily to si- development design considerations that should not ha1 deleterious environmental impact. 4) The proposed zone change is consistent with applicable C: Public Facilities Policies and Ordinances because: a) No additional demand will be placed on public facili- through the application of the Q overlay zone. NOW, THEREFCJRE. BE IT resolved by the Planning Commissic of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and conside: the applicable law, the decision of the Planning Commiss: is to APPROVE ZC-198. PASSED, APPROVED AND ADOPTED at a regular meeting of tht City of Carlsbad Planning Commission held on Earch 22, 1978, by the following vote, to wit: xx xx .2 0 0 1 2 AYES : Commissioner Larson, L'Heureux, Jose, Romboti NOES : Commissioner Fikes.
