RESOLUTION OF THE PLANNING CObIMISSION OF TEE CITY OF CARLSBAD, CALIFORKIA, DENYING A CONDITIONAL USE PERMIT FOR A THREE DAY CIRCUS ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF MARRON ROAD BETWEEN JEFFERSON STREET AND PLAZA CAMINO REAL. CASE NO: CUP-148 APPLICANT : JOHN LYONS 7 11 WHEREAS, a verified application for certain property to 811 wit: 9 Assessor's Book 154, Page 160, Parcel 27 lo Planning Commission; and XI has been filed with the City of Carlsbad and referred to the 12 WHEREAS, said verified application constitutes a request l3 21 the Conditional Use Permit (CUP-148), and found the following 2o to be heard, said Commission considered all factors relating l9 the testimony and arguments, if any, of all persons who desir l8 WHEREAS, at said public hearing, upon hearing and consid 17 law to consider said request; and l6 March, 1978, hold a duly noticed public hearing as prescribed l5 WHEREAS, the Planning Commission did on the 8th day of 14 as provided by Title 21 of the Carlsbad Municipal Code; and and reasons to exist: 22 1) The site for the intended use is not adequate in size and 23 24 25 26 2) The street system serving the proposed use is not adequal 27 shape to accommodate the use because: a) Topographic constraints including pools of standing M a large drainage ditch, natural vegetation and rollir terrain would not permit accommodation of all circus facilities as proposed. to Properly handle all traffic generated by the proposed 28 4. - - !I a rn 1 2 3 4 5 a) The proposed access point at the intersection of Jeff Street and Marron Road will create a traffic hazard a is unacceptable to both City Engineering and Police Departments. b) No parking is permitted on either side of Marron Road C) No other feasible automobile access point to proposed patron parking sites exist. 6 7 d) City Engineering Department recommends two automobile access points to service this project. 8 9 10 11 12 e) Pedestrian access on the proposed site to the circus is inadequate. The only means of getting across the drainage ditch separating customer parking from the k top area is a narrow dirt road with a large dip. f) The entire site is in generally muddy condition that ~ could create a quagmire for both cars and pedestrians if rain should occur prior or during the scheduled activity. 13 /I NOW, THEREFORE, BE IT resolved by the Planning Commissic of the City of Carlsbad as follows: 14 15 A) That the above recitations are true and correct. 16 B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi to DENY V-276 generally located on the north side of Marr 17 Road between Jefferson Street and Plaza Camino Real. 18 PASSED, APPROVED AND ADOPTED at a regular meeting of the 19 i City of Carlsbad Planning Commission held on March 22, 1978, 20 by the following vote, to wit: 21 22 AYES: ABSENT : Cmmissioner Woodward.
