RESOLUTION OF THE PLANNING CObIMISSION OF TEE
CITY OF CARLSBAD, CALIFORKIA, DENYING A
CONDITIONAL USE PERMIT FOR A THREE DAY CIRCUS
ON PROPERTY GENERALLY LOCATED ON THE NORTH
SIDE OF MARRON ROAD BETWEEN JEFFERSON STREET
AND PLAZA CAMINO REAL.
CASE NO: CUP-148
APPLICANT : JOHN LYONS
7 11 WHEREAS, a verified application for certain property to

a) The proposed access point at the intersection of Jeff
Street and Marron Road will create a traffic hazard a

Departments.
b) No parking is permitted on either side of Marron Road

d) City Engineering Department recommends two automobile
access points to service this project.

e) Pedestrian access on the proposed site to the circus
is inadequate. The only means of getting across the drainage ditch separating customer parking from the k top area is a narrow dirt road with a large dip.
f) The entire site is in generally muddy condition that

could create a quagmire for both cars and pedestrians
if rain should occur prior or during the scheduled
activity.
13 /I NOW, THEREFORE, BE IT resolved by the Planning Commissic
of the City of Carlsbad as follows: 14
15 A) That the above recitations are true and correct.
16 B) That in view of the findings heretofore made and consider
the applicable law, the decision of the Planning Commissi

18 PASSED, APPROVED AND ADOPTED at a regular meeting of the
