HomeMy WebLinkAbout1978-04-12; Planning Commission; Resolution 1436.- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 m e PLANNING COMMISSION RESOLUTION NO. 1436 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR THE EXPANSION OF AN EXISTING SERVICE STATION TO PERMIT A LAUNDRY AND DRY CLEANING PICK-UP SERVICE ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF ELM AVENUE AND HARDING STREET. CASE NO. CUP-147 APPLICANT : BARBARA COLTON WHEREAS, a verified application for certain property to wit: The certain real property in the City of Carlsbad, Count of San Diego, State of California described as all of tk Lots Nos. 1, 2, 3 and 4 in Block No. 67, Carlsbad Townsi Map No. 535, recorded in the Office of the County Record of San Diego County May 2, 1588 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 8th day of March, 1978, hold a duly noticed public hearing as prescribed law to consider said request; and WHEREAS, at said public hearing, upon hearing and consid the testimony and arguments, if any, of all persons who desi1 to be heard, said Commission considered all factors relating the Conditional Use Permit, (CUP-147) and found the followins and reasons to exist: 1) Requested use is essentially in harmony with the various elements and objectives of the General Plan and will not detrimental to existing uses, or to uses specifically per to a zone in which a proposed use is to be located becauc a) The General Plan indicates that a laundry dry clean -g use is appropriate in the central business district. W W 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 b) The existing building design, traffic circulation, ar parking are adequate and compatible with the surrounc areas. c) The site has good access with two street frontages ar alley, thus giving easy ingress and egress for this c pick-up type use. 2) 3) The site for the intended use is adequate in size and shi to accommodate the use because: a) The site is relatively large and adequate to accommoc the existing use and the proposed use. There is amp1 area for parking on the west side of the building wit area for drive up and quick access along the east sic the building. b) Many of the customers will be using both uses. The customer would make one stop to get gas and pick-up' cleaning. All yards, setbacks and other features necessary to adjur the requested use to eixting or permanent uses in a neigl hood will be provided and maintained because: a) The site is already developed and all facilities are adequate. b) There is adequate space on site to accommodate parkir traffic flow. B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi to APPROVE CUP-147, subject to the following conditions: 1) Approval is granted for the land described in the applica and with the attachments thereto, except that a revised F plan must be submitted as required below. 2) A revised accurately drawn plot plan be submitted which includes all requirements of an automobile service static section 21.42.010(7) as listed below: a) Perimeter planters around entire service station sit€ and adjacent to the structures where feasible. b) The landscpaed areas to have a minimum width of 6' ar a 6 inch concrete curb. c) Landscaping to be indicated and to include a combinat of flowers, shrubs and trees. d) A sprinkler system providing total and effective COVE to all landscaped areas. e) A statement delineating a maintenance schedule and responsibility for maintenance of landscaped areas. f) A 6' high enclosure for trash containers. 9) Concrete sidewalks and driveway ramps to be built to City standards to replace existing asphalt sidewalks and driveway ramps along Elm Avenue. h) Sidewalks shall contain necessary drains to carry wa. from site to gutter. 3) All proposed parking and onsite traffic circulations sha indicated on plan to the satisfaction of the Planning Di. 4) The required revised plot plan shall be submitted and ap: by the Planning Director as meeting the zone code requirl and the conditions of the CUP within three months from t: of approval, or the conditional use permit shall become and void. 5. The Traffic Engineer shall approve the traffic plan and traffic control measures as recommended by the City Engi be installed. I/////// .3 ., 1 2 3 4 5 6 7 8 9 1.0 11 12 13 14 15 16 e 6) Street trees to be provided on all street frontages as recommended by the Parks and Recreation Director. 7) No other use other than the existing service station and proposed dry-cleaning laundry pick-up shall be permitted this site with the approval of an amended CUP. 8) The CUP be reviewed by the Planning Commission within 6 XI after the date of occupancy of the requested use to deter if the subject use is adversely affecting the health and safety of the area. If a determination is made that the does have an adverse affect, the Planning Commission shal order the opening of a public hearing to determine if the concerns are valid, or mitigating conditions should be ad or the application be denied. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on April 12, 1978, the following vote, to wit: AYES : Commissioner Larson, Woodward, Rombotis, Yerkes.
