HomeMy WebLinkAbout1978-05-10; Planning Commission; Resolution 14451 2 3 4 5 6 7 8 9 LO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i m m PLANNING COMMISSION RESOLUTION NO. 1445 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO AMENDING TITLE 21 OF THE MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 21.04.180, 21.04.195, 21.04.378, 21.07.030, 21.08.010, 21.09.030, 21.10.010, 21.30.010, AND 21.44.075 TO REVISE THE PERMITTED USE REGULATIONS REGARDING THE KEEPING OF CHINCHILLAS, DOGS AND CATS. CASE NO: ZCA- 9 6 APPLICANT: CITY OF CARLSBAD WHEREAS, the Carlsbad City Council directed the Plannin! Commission to conduct a public hearing to consider a Zone Coc Amendment amending Sections 21.04.180, 21.04.195, 21.04.378, 21.07.030, 21.08.010, 21.09.030, 21.10.010, 21.30.010 and 21.44.075 to revise the permitted use regulations regarding 1 keeping of chinchillas, dogs and cats; and WHEREAS, the Planning Commission did hold a duly notice( Public Hearing as prescribed by law on April 26, 1978, and 01 May 10, 1978, to consider the subject amendment; and WHEREAS, at said public hearing, upon hearing and consic the testimony and arguments, if any, of all persons who desi] to be heard, said Commission considered all factors relating the Zone Code Amendment and found the following facts and re; to exist: 1) The Zone Code does not clearly differentiate in the defil section between a "kennel" and "veterinarian and small a1 hospital". 2) The Zone Code does not clearly distinguish whether a "kel means a place where four or more adult dogs or cats are kept individually by animal type or in combination. 3) Chinchilla raising currently receives unusual preference over other similar type animals in the Zoning Code. 4) There is a conflict in the Zoning Code regarding the use of veterinarians, kennels, and small animal hospitals in the Heavy Commercial-Limited Industrial Zone (C-MI. 1 I ll m 0 1 5) The common practice of keeping dogs, cats and other house pets is presently not addressed as a permitted use in moe 2 NOW, THEREFORE, BE IT RESOLVED, by the Planning Commissi 3 zones of the Code. 4 City Council of an amendment to Title 21 of the Municipal Cod 5 of the City of Carlsbad that it does recommend approval to tk as set forth in Exhibit "A" dated April 28, 1978, attached he 6 7 PASSED, APPROVED AND ADOPTED at a regular meeting of the 8 the following vote, to wit: 9 Carlsbad City Planning Commission held on May 10, 1978, by 10 11 12 13 14 15 16 1'7 18 AYES : Commissioner Woodward, Larson, L'Heureu, Jose.
