PLANNING COMMISSION RESOLUTION NO. 1460
RESOLUTION OF THE PLANNING COY?ISSION OF THE CITY
CONDITIONAL USE PERMIT 42 (CARLSBAD RF-CEWAY) TO
ALLOW CONSTRUCTION AND OPERATION OF A FIBERGLASS SLED RUN ON A NATURAL SLOPE.
CASE NO. CUP-42 (F)
OF CARLSBAD, CALIFORNIA, APPROVING AN ATTENDP.IE1JT TO
APPLICANT: Herb Motz
WHEREAS, a verified application for certain property, to
wit:
S4 of NW& and SW& of NE% all in Section 18T. 12 S.
R. 3 W., S.B.B.M., being Assessor's Parcels 2, 3, &
14 of Book 221, Page 101 of the Assessor's Map of
San Diego County
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
approved by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 26th day of
July, 1978, hold a duly noticed public hearing as prescribed 1
law to consider said request: and
WHEREAS, at said public hearing, upon hearing and considc
the testimony and arguments, if any, of all persons who desirc
to be heard, said Commission considered all factors relating t
the CUP-42(F) and found the following facts and reasons to exi
1. That the requested use is desirable for the development c
the community, is essentially in harmony with the various elen
and objectives of the General Plan, and is not detrimental to
existing uses or to uses specifically permitted in the zone ir
which the proposed use is to be located:
a. The General Plan calls for Recreational-Commercial 1

use on the subject property.
b. The zoning for the subject property is C-2.
c. Surrounding property designated by the General Plan
non-residential reserve will not be detrimentally
affected.
d. Carlsbad Raceway is an existing Recreational-Commerc
use which the proposed project will be compatible w.
2. That the site of the intended use is adequate in size anc
shape to accommodate the use:
a. The natural terrain will be used for the proposed s:
and will minimize excessive grading.
b. The site is a normal drainage course and the projec.
will not alter the existing drainage pattern.
c. Adequate parking exists on the site to accommodate
proposed use.
3. That all of the yards, setbacks, walls, fences, landscap
and other features necessary to adjust the requested use to
existing or permitted future uses in the neighborhood will be
provided and maintained.
a. The project has been reviewed to ensure compliance 7
the above.
4. That the street system serving the proposed use is adequ,
to properly handle a11 traffic generated by the proposed use.
a. Palomar Airport Road and Rancho Santa Fe Road are
adequate raodways to accommodate the additional tra at this time.
b. The two above facilities are designated by the
Circulation Element of the General Plan as prime ma arterials able to carry traffic in excess of 40,000
vehicles per day.
c. While the street system is adequate to carry the tr<
generated by the proposed sled run, it is recognizec that the design of the intersection of Palomar Airpc
Road, Linda Vista Road and the primary access drive
the site does not provide a desirable traffic circu
tion pattern.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio:
the City of Carlsbad as follows:
That the above recitations are true and correct.

That in view of the findings heretofore made and considering
the applicable law, the decision of the Planning Commission ir
APPROVE the CUP-42(F), subject to the following conditions:
1. The amendment to CUP-42(A), known as CUP-42(F), is appro'
for the use described in this application and with the
attachments therero and on plot plan labeled Exhibit A
dated 5/29/78. Location of all buildings, parking, land,
scaping and other facilities shall be situated substanti;
as shown on the plot plan except as provided for herein.
2. The amendment to CUP-42(A), known as CUP-42(F) shall exp
on the same date as CUP amendment 42(D) , April 25, 1982.
3. No alcoholic beverages shall be permitted on the grounds
premises of the sled run.
4. Operating hours for the sled run shall be confined to 9:
A.M. to 9:OO P.M.
5. If the applicant wishes to install night lighting at som, future date, approval by the Planning Director shall be required and the lighting plan shall be submitted to the Planning Director for approval prior to application for
building permits.
6. A landscaping and automatic sprinkler system plan for erl
control of any grading relating to the proposed use shal
submitted to the Planning Department for approval prior
issuance of building permits. The plan shall incorporat
water conservation measures.
7. Sanitary facilities acceptable to the County Health Depa ment and the City Public Works Department shall be provi

8. All signs advertising the sled run, which are viewable f
off the site shall conform to the City of Carlsbad sign
regulations. A sign program for interior oriented direc
service and advertising purposes shall be approved by th
Planning Director.
9. The construction privilege ereby granted are granted so
to the owner, his vestee or + agent in said construction a
these privileges are not transferable without the expres
consent of the City Council of the City of Carlsbad.
10. Planning Commission shall review the operation every fiv
years to determine if the sled run is detrimental to
surrounding properties or traffic movement. If it is
determined that the sled run may be detrimental, the
Planning Commission shall request hearings to reconsider
this Conditional Use Permit Amendment.

11. A 20 foot wide all weather road shall be provided to the bottom of the slide for emergency access to the satisfac: of the Fire Marshall.
12. Adequate fire fighting facilities shall be provided to tl
site to the satisfaction of the Fire Marshall prior to
issuance of building permits.
13. The owners of the subject property shall work with City I to prepare a plan for improved access to the Carlsbad Rac
property. The plan shall be approved by the City Engine1
prior to processing any other application for the racewal
property covered by CUP('D) .
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City of Carlsbad Planning Commission held on August 9, 1978
by the following vote, to wit:
