HomeMy WebLinkAbout1978-09-13; Planning Commission; Resolution 14691 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 ~ 20 21 22 23 24 25 26 27 28 w W PLANNING COMMISSION RESOLUTION NO. 1469 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD APPROVING A CONDITIONAL USE PERMIT TO ALLOW OCCUPANCY OF THE MAGEE HOUSE PRIOR TO THE COMMENCEMENT OF PUBLIC IMPROVEITENTS AND DEVELOP- MENT OF ON-SITE PARKING LOT. CASE NO: CUP-118 (A) APPLICANT : CITY OF CARLSBAD WHEREAS, a verified application for certain property, generally located on the north side of Beech Avenue between Garfield Street and Carlsbad Boulevard, and more particularly described as: Portion of Block 3 of Carlsbad, County of San Diego, State of California, according to map thereof No. 775, filed in the Office of County Recorder of San Diego County. February 15, 1894, and more particularly described in application on file in the City Planning Off ice has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 13th day of September, 1978, hold a duly noticed public hearing as prescr by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consid the testimony and arguments, if any, of all persons who desir to be heard, said Commission considered all factors relating the Conditional Use Permit, and found the following facts and reasons to exist: 1. Approval of this amendment does not change the nature of the original Conditional Use Permit, but will only allow an I1 w W 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 earlier, partial occupancy. WHEREAS, the Planning Commission by the following roll c vote APPROVED CUP-118 (A) with the following conditions: 1. Magee House shall not be used for assemply type uses or purposes until the conditions of Planning Commission Resoluti No. 1241 have been fulfilled. 2. Magee House may be used for storage and office use. 3. Prior to any occupancy Magee House shall be inspected b> the Fire Marshall and the Building Inspector to insure compli with applicable codes. 4. The conditions of this CUP-l18(A) shall be reviewed by t Planning Commission in six (6) months to assure compliance. AYES : Rombotis, Larson, Marcus, Jose NOES : Wrench, Schick ABSENT: L'Heureux ABSTAIN: None NOW, THEREFORE, BE IT RESOLVED that the above recitatior are true and correct.
