CASE NO. CUP-159 APPLICANT : Don Sharp ~~ WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; anl WHEREAS, said verified application constitutes a reques as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal COI the Planning Commission did on the 22nd day of November, 197 hold a duly noticed public hearing to consider said applicat. on property described as: Lot 8 of Carlsbad Tract 72-3, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 7492, filed in the office of the County Recorder of San Diego County, November 20, 1972. WHEREAS, the City of Carlsbad, acting as Lead Agency, 1 has determined that the CUP-159 will not have a significant I impact on the environment and is, in fact, categorically exe from the requirements of the Carlsbad Environmental Protecti Ordinance as construction of minor appurtances to existing commercial facilities.; and WHEmAS, at said public hearing a staff report was subm and all persons desiring to speak on the subject request wer heard. The requested use is desirable for the development of tl community, is essentially in harmony with the various element and objectives of the general plan, and is not detrimental tc existing uses or to uses specifically permitted in the zone j which the proposed use is to be located because: a. The use is allowed by code and specific plan no. l! b. The proposed sign represents no apparent conflict E the general plan. 2. That the site for the intended use is adequate in size 2 shape to accommodate the use. 3. That all of the yards, setbacks, walls, fences, landsca] and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will bc provided and maintained because it is already required by co( and will be further required by this CUP. 4. That the street system serving the proposed use is adeql to properly handle all traffic generated by the proposed use WHEREAS, the Planning Commission by the following vote APPROVED CUP-159 subject to certain conditions: AYES: Rombotis, L'Heureux, Schick, Wrench, Marcus, Jose, Larson NOES : None NOW, THEREFORE BE IT HEREBY RESOLVED that the CUP-159 filed by Don Sharp to allow the installation of a free-stand sign is hereby APPROVED subject to the following conditions: 1. This approval is granted for the property described in application only. 2. The sign shall substantially resemble the sign depicted Exhibit A, dated 11/22/78 on file in the Planning Department 3. The sign shall be placed as shown on the site plan labe Exhibit B, dated 11/22/78 on file in the Planning Department 4.
