MENT PLAN FOR THE GRADING OF APPROXIMATELY 140,000 CUBIC YARDS OF SOIL ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL, ONE MILE NORTH OF PALOMAR AIRPORT ROAD. CASE NO. SDP 78-1 APPLICANT : Don Hubbard WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; an WHEREAS, said verified application constitutes a reques as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Co the Planning Commission did on the 22nd day of November, 197 consider said application on property described as: That portion of Lot "B" of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 823, filed in the Office of the County Recorder of San Diego County, November 16, 1896; and WHEREAS, the City of Carlsbad, acting as Lead Agency, 11 determined that the SDP 78-1 will not have a significant impact on the environment and has filed a negative declarati for this project and that the project is in full compliance with the City of Carlsbad Environmental Protection Ordinance 1972, and the State E.I.R. Guidelines; and WHEREAS, at said Planning Commission meeting a staff re was submitted and reviewed. At the conclusion of said heari after consideration of all evidence presented, the Planning Commission found the following facts and reasons to exist: // ..I - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i 1. j The proposed project is consistent with zoning and the General Plan because: a. The zoning and land use designations call for an industrial use of the site. This application is only t grade the site; however, future use will be restricted to those allowed in the I'M" zone. b. The application of the "Q" overlay will insure compliance with the General Plan guidelines for the Pal Airport Impact Area. 2. The environmental concerns associated with the project been adequately addressed and the potential significant impa mitigated by revisions to project design and by the conditic of approval of this site development plan. WHEREAS, the Planning Commission by the following vote APPROVED SDP 78-1 subject to certain conditions: AYES : Rombotis, Schick, Wrench, Marcus, Jose, Larsc NOES : L ' Heureux NOW, THEREFORE BE IT HEREBY RESOLVED that the SDP 78-1 filed by Don Hubbard to allow for the grading of approximate 140,000 cubic yards of soil is hereby APPROVED subject to tk following conditions: 1. Approval of the site development plan is for the land described in the application and for the grading project as shown on the map labeled Exhibit A, dated 11/22/78. DeveloF other than the grading is not approved. 2. Any future development entitlements for the site shall subjected to further environmental review and the site devel ment plan process. 3. A minimum 8-foot high screening berm, incorporating the natural ridge shall be provided from a point beginning betwe the two proposed pads and following the natural ridge eastwa to the limits of the proposed grading as indicated on Exhibi dated 11/22/78, on file in the Planning Department. // // ii -2- ll w w 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4. A minimum one foot high berm with a minimum eight foot chain link fence with wood slats on top shall be provided fr a point between the two pads westward and southward to scree westerly pad from the north and from El Camino Real, as show on Exhibit A, dated 11/22/78, on file in the Planning Depart 5. A detailed landscape and irrigation plan shall be appro by the Planning Department prior to the issuance of grading permits. The landscape and irrigation plan shall provide fo irrigation of the filled portions of the existing north slop with native vegetation and for landscape screening of the tw proposed pads. 6. Three of the four mature Toyon trees along the ridge of the north slopes shall be left undisturbed. 7. The following shall be accomplished to the satisfaction of the City Engineer prior to the issuance of grading permit a. A final grading plan shall be approved by the City Engineer. Said grading plan shall incorporate the cond of approval of this entitlement (SDP 78-1) and shall be an attachment thereto. b. The property owner shall dedicate an 18 foot wide of land along the El Camino Real frontage for future st right-of -way. c. Provide for a 60 foot right-of-way along the soutk: boundary of the site that is all useable to provide acc the property to the east of the subject site. Said 60 right-of-way may include any portion of the previously dedicated 30' right-of-way along the comon property li the adjacent property to the south (Beckman Instruments d. Grading of the site to be accomplished in such a manner so as not to interfere with future development c right-of-way along the south property line. e. All graded areas shall be planted for erosion cont immediately after grading. f. Drainage shall be conducted off the site in a manr acceptable to the City Engineer. 8. The identified archaeological site shall be protected f disruption during development of the site.
