RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL
USE PERMIT TO CONSTRUCT A MUNICIPAL SWIM COMPLEX
ADJACENT TO CARLSBAD HIGH SCHOOL. ,
CASE NO. : CUP-158

heard. At the conclusion of said hearing, after consideratio
of all evidence presented, the Planning Commission found the
following facts and reasons to exist:

That the requested use is desirable for the development .of the community, is essentially in harmony with the var
elements and objectives of the General Plan, and is not
detrimental to existing uses or to uses specifically per
mitted in the zone in which the proposed use is to be
located because (a) the development will provide a need recreational and educational resource to the City and the school district in a manner consistent with the Park and Recreation element of the Carlsbad General Plan; and (b) the identified potentially significant effect will mitigated by project design and facility management.
That the site for the intended use is adequate in size a
shape to accomodate the use; (a) the site contains 4.68
acres. The Carlsbad General Plan anticipates a size of acres for such a use; and (b) all necessary facilities included in the project design, which are comfortably lo
on the site plan for the project: and (c) the adjoining
high school provides extra parking and casual assembly a

Conditions
1. The approval is granted for the land described in the
application and any attachments thereto, and as shown on
the site plan labeled Exhibit A and dated November 8, 197
2. Development shall occur substantially as shown on the sits
plan labeled Exhibit A and dated November 8, 1978.
3, Prior to issuance of building permits, a landscape and
irrigation plan for the subject site shall be approved by
the Planning Department. Said plan to include:
(a) Water conservation measures;
(b) Low maintenance plant material: and
(c) Automatic irrigation system.
4. A street tree planting plan shall be approved by the Dire
of Parks and Recreation prior to the issuance of building
permits. The plan will include the street frontage along
pool site.
5, The land use and noise impacts of the projects shall be
reduced by site design of the project for noise attenuati
and so that the majority of noise will be directed away f
the existing residences.
6. Site design shall include a solid masonry wall around the
facility of the same height as indicated on the plan labe
Exhibit B, dated January 24, 1979.
7. Competition events at the pool shall be scheduled during
daylight hours.
8. Use of the pool shall be restricted between the hours of
P.M. and 6:OO A.M. in order to reduce noise. In the inst
of a special event, as approved by the Parks and Recreati
Department, the pool hours may be extended until 11:OO P.
Fridays, Saturdays, and holidays only.
9. The driveway on Monroe to be abandoned will be removed ai
replaced with curb, gutter and sidewalk.
10. A drafting hydrant shall be connected to the pool and in! to the satisfaction of the Fire Marshall.
11. Prior to issuance of building permits, a solar hearing p.
for the subject site shall be approved by the Planning
Department and Public Works. Said plan to include:
(a) The solar energy system should supplement at least
of the pool's annual heating requirement.
(b) Any solar collectors used in said system should be I
fectively screened from public view.
(c) The plan must facilitate the addition of said solar
system at a later date, if not economically feasibl
this time.

12. Speed bumps shall be provided in the parking lot in ordc to promote public safety.
NOW, THEREFORE, BE IT HEREBY RESOLVED, that the above
recitations are true and correct.
