PLANNING COMMISSION RESOLUTION NO. 1491
=SOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CALRSBAD, CALIFORNIA, APPROVING A SITE
DEVELOPMENT PLAN AMENDMENT TO CONSTRUCT THE THIRD PHASE OF A NEIGHBORHOOD SHOPPING CENTER.
CASE NO. : SDP 77-1 (B) APPLICANT: Mola Development
WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Cod
the Planning Commission on the 24th day of January, 1979,
considered said application on property described as:
Situated in the State of California, County of San
Diego, Parcels 1, 2 and 3: All that portion of the
west half of the northeast quarter of Section 26,
Township 12 south, Range 4 west, San Bernardino Meridian, in the County of San Diego, State of California, according to official plat thereof, and also listed in the County Assessor's Book No. 215, Page 25, Parcel 49-55-511.
WHEREAS, the City of Carlsbad, acting as Lead Agency, ha
determined that the SDP 77-1(B) will not have a significant
impact on the environment and has filed a Negative Declaratic
for this project and that the project is in full complaince
with the City of Carlsbad's Environmental Protection Ordinanc
1972, and the State EIR Guidelines; and
WHEREAS, at said Planning Commission meeting a staff reg
~ was submitted and reviewed. At the conclusion of said hearir
after consideration of all evidence presented, the Planning
Commission found the following facts and reasons to exist:

1. The proposed development is compatible with the approvec
Site Development Plan, SDP 77-1, because:
a) The proposed use is consistent with the commercial
of the development, and is approximately the same :
footage anticipated when SDP 77-1 was approved.
b) The building elevations demonstrate architectural
patibility.
c) The conditions of approval for this amendment will
compatibility with the approved site plan.
2. The development will occur towards environmental factors
An EIR for the entire project was certified on May 6, 19
Adequate mitigation has been provided.
3. The street system servicing the project is adequate to
handle the traffic generated by the proposed project bec
all necessary public improvements are required as a con6 of approval for SDP 77-1.
4. The project is consistent with the general plan because
general plan provides for a neighborhood commercial dew
ment on this site and the proposed prjoject meets the cri
for a neighborhood shopping center.
WHEREAS, the Planning Commission, by the following vote,
APPROVED SDP 77-1(B), subject to certain conditions:
AYES: L'Heureux, Rombotis, Marcus, Jose, Wrench, Schick, Larson
NOES : None
1. Approval is granted for the portion of the property desc
in this application and shown on Exhibit "A", dated 1/24
2. The drive-thru provisions for the bank shall be for one
only and shall be wide enough to accomodate an "escape
lane". Final design of the drive thru window lane shall
be to the satisfaction of the City Engineer.
3. This approval shall expire in one year from the date of
approval unless building permits are issued and kept act
The conditions listed above are to be in addition to all of t
conditions of approval for SDP 77-1 as stated in Planning

NOW, THEREFORE, BE IT HEREBY RESOLVED that the above
