CASE NO. : SDP '78-3 APPLICANT : William Burnett WHEREAS, a verified application has been filed with the of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Cod the Planning Commission, on the 14th day of March, 1979, considered said application on property described as: All those portions of Lot 9, together with that portion of the Southwest Quarter of the Southeast Quarter, all in Seciton 35, Township 12 South, Range 4 West, San Bernardino Meridian, in the County of San Diego, State of California, WHEREAS, the City of Carlsbad, acting as Lead Agency, hz determined that the SDP 78-3 will not have a significant impz on the environment and has filed a Negative Declaration for t project and that the project is in full compliance with the C of Carlsbad's Environmental Protection Ordinance of 1972, and State EIR Guidelines in that: 1. The project complies with the zone designation of the si 2. Adequate mitigation is to be provided by project design for traffic and geologic concerns. 3. Destruction of natural environment, habitat, flora and fauna is not a concern. Access drives shall be 8% or flatter with a maximum 5% transition of 20' where drives enter the public streets 2. Foundation design shall be designed or approved by a qualified soils engineer. 3. All the mitigations of EIA Log No. 406, Negative Declari (copy attached) shall be incorporated into the project. 4. This review pertains to the plot plan labeled Exhibit 'I: dated December 22, 1978, and made attachment hereto. AI deviation from this plan may require further environmen- review. 5. Failure to incorporate these conditions into the projec. nullify this Negative Declaration and re-open the initii study of the subject property. WHEREAS, at said Planning Commission meeting a staff re] was submitted and reviewed. At the conclusion of said hearil after consideration of all evidence presented, the Planning Commission found the following facts and reasons to exist: The proposed development is compatible with surrounding land uses because: 1. Proper vehicular access and traffic controls are being provided; 2. The project area is separated topographically from the residential areas to the east: 3. The design of this development is consistent with other commercial centers along El Camino Real and considerate the special character of this scenic corridor. The project has complied with the requirements of the Carlsbad Environmental Protection Ordinance of 1972 because i Negative Declaration (EIA, Log No. 514) has been issued on tl proposed project. The application is consistent with applicable City Pub1 Facility Policies and Ordinances because all public facilitic are available except sewer. The site has been approved for 1 systems as a means of sewage disposal. WHEREAS, the Planning Commission, by the following vote APPROVED SDP 78-3, subject to certain conditions: 1. A final reproducible Site Development Plan will be submitted prior tl issuance of building permits, indicating modifications reflec in the following conditions. Any additional significant cha to the Site Plan will require further review by the Planning Commission. 2. A minimum 10 foot landscaped setback will be provided a: all street frontages. 3. All slopes are to be landscaped and irrigated. The lar! slope on the eastern portion of the property will be hydro-s( immediately upon completion of grading operations. 4. A landscape and irrigation plan shall be submitted and approved by the Planning Department prior to issuance of bui: permits. Said plan to incorporate water conseration measure: 5. The driveway entrance from La Costa Avenue must be aligr with the existing driveway on the north side of the street. 6. Driveway entrance grades may not exceed 5%, and no othe~ driveway grades are to exceed 8%. 7. Grading will occur in accordance with City standards ant approved soils and geologic investigation. This report will indicate slope stability calculation and specifications. 8. Site design will allow for future incorporation of the corner lot into the proposed shopping center. Access must be provided from the proposed center. 9. A pedestrian/equestrian trail along the eastern slope of property will be indicated on the final Site Development Plar The trail shall be improved and accepted by the Director of E and Recreation and City Engineer prior to occupancy of buildi The design and improvement plans shall be approved prior to issuance of building permits. LO. A sign program shall be submitted and approved by the Planning Director prior to issuance of building permits. All illegal or unapproved signs presently existing on the propert will be removed prior to issuance of building permits. 11. Roof top equipment will be screened from adjoining resid use and public streets. 12. Dedication and improvements to El Camino Real, including a raised median and one signalized median opening, shall be provided to the satisfaction of the City Engineer. 13. A looped water line to meet required water flows and hy locations to be provided to the satisfaction of the Fire Mar prior to issuance of building permits. 15. Parking shall be provided pursuant to the Carlsbad Muni Code. Credit shall be given for bank drive-thru windows at rate of 7 spaces for each window. 16. Fire access to the rear of the buildings shall be provi to the satisfaction of the Fire Marshal. A sidewalk will be provided around the eastern building for emergency services access. 17. Additional pedestrian sidewalks will be indicated on th Site Development Plan along the driveway entrance from La Co Avenue and adjacent to the east side of the proposed market. Sidewalks are also required along the El Camino Real and La Avenue street frontages. 18. The drive-thru lane serving the proposed bank is unacce as shown due to inadequate turning radius. A redesign appro by the City Traffic Engineer will be included on the final S Development Plan. 19. The main driveway from El Camino Real as shown on Exhib. dated March 14, 1979, shall be widened on the final Site Devc ment Plan to provide 24 foot wide ingress opening and 24 foo, wide egress opening. Each of these openings shall facilitatr 12 foot lanes. 20. An additional bus stop near the proposed market or at a: location approved by the North County Transit District will : indicated on the final Site Development Plan. 21. Prior to acceptance of a building permit application, t. application must provide the Engineering Department with cop: of the approved percolation test report and a receipt for a : tank permit from the County Department of Public Health. 22. The floor areas for the structures as shown on Exhibit i dated March 14, 1979, are approved only to the extent that tl applicant can receive septic approvals, and that the septic system meets the City requirement of 270 gallons per day of effluent for each 1800 square feet of gross floor area. 23. Lighting for the shopping center shall be shielded from adjoining residential uses. 24. Trash areas shall be enclosed and screened with shrubs E other landscaping. 25. Commercial PROJECT LOCATION Southeast of-the intersection of La Costa Avenue and El Camino Real I declare that I have examined the information for the above project as submitted by the applicant, and on the basis of the Environmental Impact Assessment questionnaire on file in my office as a public document, it is my determination that this project will not have any significant impact upon the environment within the meaning of the Ca'lifornia Environmental Qu.ality Act of 1970 and the Environmental Protection Ordinance of 7912 for the following reasons: 1.' The site is a very disturbed environment. Sensitive development can improve the aesthetics and' stabilize adverse geologic conditions on site. 2. The developer has agreed to mitigate the 'adverse aesthetic impacts by consenting to the initiation of-a Q zone overlay application on the site. 3. The developer' has agreed to mitigate the geologic impacts by the submission of a detailed geologic study prepared by a qualified geologic engineer. Such study shall propose methods to mitigate all adverse soil, slope and geologic conditions on the site. ... 4. The developer has agreed to mitigate all traffic impacts which might be associated with the development of the property with a Community Commercial use by doing the following: a. Only one median opening along El Camino Real shall be permitt and it must be located approximately equidistant between La Costa Avenue and Levante Street (at approximately driveway labeled I'H" in the attached plan). -6- r v w b. Only one -additional ,driveway shall, be permitted along El Cami Real with "right turns in,, right turns out.only" (at approx- imately driveway "D"). c. An internal circulation system must connect all of the pro- posed buildings within the d.evelopment. d. Only one driveway is to be located along La Costa Avenue as far from El Camino Real as feasible. e. All driveways must incorporate a "throat" design in order to facilitate adequate storage for stopped vehicl-es. f. A traffic signal shall be required at the proposed median bre along El Camino Real (at driveway "Hi'.). g. A raised landscaped median must be constructed along El Camir; Real to Levante Street. h. Rechannelization and other geometric changes will be necessar at the signalized intersection of El Camino Real .and La Costa Avenue. i. Pedestrian and bicycle facilities must be provided throughout the proposed center. j. Transit facilities must also be incorporated into the design. ' k. An interconnect system must be designed between the signals c El Camino Real at La Costa Avenue and at driveway "H".
