CASE NO: MS-394 APPLICANT: NORRIS ~~ ~ ~ WHEREAS, the Carlsbad Municipal Code, Section 21.10.080, provides that any panhandle lots within a minor subdivision IT be approved by the Planning Commission, and; WHEREAS, pursuant to the provisions of the Municipal Code the Planning Commission did, on the 11th day of April, 1979, consider said minor subdivision and panhandle lot on property generally located at 2629 Wilson Street, Carlsbad; and ...: WHEREAS, the City of Carlsbad has determined the Minor Subdivision 394 to be consistent with the City of Carlsbad's Environmental Protection Ordinance because it is categorical1 exempt from review according to Section 19.08.090 which exemp lot splits and panhandle lot determinations in an urbanized R Zone. WHEREAS, at said Planning Commission meeting a staff rep0 was submitted and reviewed. At the conclusion of said hearin after consideration of all evidence presented, the Planning Commission found the following facts and reasons to exist: 1. The panhandle is consistent with the General Plan because it is within the allowed density. 2. The property cannot be adequately served by a public stre since there is no street access for the rear portion of t lot and none is proposed. // -1- " . I1 w 0 I/ 1 2 3. The approval of this panhandle lot will not preclude publI street access to other properties in the same block. A. No public or private streets have yet been projected : 3 this block. 4 I/ B. A street in this block could bypass the subject propel entirely. 5 4. The buildable portion of Parcel 2 meets the requirements ( 6 7 portion of the lot which is narrower than 35 feet. Section 21.10.080, It is 15,700 square feet and excludes wide as required. 8 5. The panhandle portion of the lot is 150 feet long and 20 : 9 11 6. The proposed map is consistent with applicable City Public Facilities Policies and Ordinances. 10 A. Both lots will use a septic system. WHEREAS, the Planning Commission, by the following vote, approved MS-394, subject to certain conditions: 1. The yard requirements shall be the same as for the R-1-75 l8 I 2. An improved driveway shall be provided within the access portion of the lot from the public street to the parking single lots. The minimum overhead clearance shall be ten service vehicles with a minimum of two inch thick asphalt 19 21 feet. The front lot line shall be the northeastern line of the buildable portion of Parcel 2. From the northwestern mos property line, the front lot line runs southeast for 85 f east for 41 feet, and southeast for 35 feet.
