A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING A VARIANCE
TO REDUCE THE NUMBER OF REQUIRED PARKING SPACES
FOR A CONDOMINIUM PROJECT FROM 183 SPACES TO 128
SPACES ON PROPERTY GENERALLY LOCATED NORTHEAST
OF EL CAMINO REAL BETWEEN ALGO ROAD AND PALOMAR
AIRPORT ROAD.
CASE NO. : V-291
APPLICANT: Peter Von Elten
WHEREAS, a verified application for certain property,
to wit:
That portion of the West Half of the Northeast Quarter of Section 26, Township 12 South, Range
4 West, San Bernardino Meridian, in the County
of San Diego, State of California, according to
official plat thereof recorded in the office of
the County Recorder on December 30, 1977
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a reques
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 25th day of
April, 1979, hold a duly noticed public hearing as prescribe1
by law to consider said request; and
WHEREAS, the City of Carlsbad has determined V-291 to b consistent with the City of Carlsbad's Environmental Protect
Ordinance because it is categorically exempt from review
according to Section 19.04.090(4)(~) which exempts parcel
splits minor alterations in land use limitations.
WHEREAS, at said public hearing, upon hearing and con-
sidering the testimony and arguments, if any, of all persons
desired to be heard, said Commission considered all factors
relating to the Variance (V-291) and found the following fac
and reasons to exist:
1. There are no exceptional or extraordinary circumstances or conditions applicable to this property that do not apply
generally to the vicinity and zone.
2. The property is not being denied a substantial property
right possessed by other property in the vicinity and zone.
Other condominium conversions in the area and zone must meet
the same requirements.

3. The variance may be detrimental to surrounding propertic
by causing residents of this project to park in neighboring
projects.
4. The variance is not consistent with the guidelines of tl
General Plan since adequate off-street parking has not been provided.
WHEREAS, the Planning Commission, by the following vote
denied V-291, for the reasons as set forth above.
AYES : L'Heureux, Rombotis, Schick, Marcus, Jose, Larson
NOES : None
ABSENT: Wrench
NOW, THEREFORE, BE IT HEREBY RESOLVED that the
above recitations are true and correct.
