HomeMy WebLinkAbout1979-05-09; Planning Commission; Resolution 1515I .,. + I1 w w 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 PLANNING COMMISSION RESOLUTION NO. 1515 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, FOR THE DEVELOP- MENT OF A 10,000 SQUARE FOOT PROFESSIONAL OFFICE BUILDING AND PLAZA, ON PROPERTY GENERALLY.LOCATED ON THE WEST SIDE OF PI0 PIC0 DRIVE BETWEEN LAS FLORES DRIVE AND BUENA VISTA AVENUE. CASE NO. : SDP 78-4 APPLICANT: Kubota WHEREAS, a verified application has been filed with the of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reques as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Co the Planning Commission, on the 25th day of April, 1979, considered said application on property described as: A portion of Lot 4, Section 31, Township 11, South Rang 4 West, S.B.B. & M. City of Carlsbad, County of San Diego, State of California WHEREAS, the City of Carlsbad, acting as Lead Agency, h determined that the SDP 78-3 will not have a significant impact on the environment and has filed a Negative Declarati this project as in full compliance with the City of Carlsbad Environmental Protection Ordinance of 1972, and the State E1 Guidelines in that: 1. The proposed development is compatible with the Carlsba General Plan, 2. The project will occur in an already urbanized area. 3. The trees eliminated by the proposed development will bc replaced with extensive planting throughout the project site. 5. The development will be sewered initially with a septic system approved by appropriate County and City Departmel The degree of development permitted will not exceed the amount authorized by these departments. WHEREAS, at said Planning Commission meeting a staff re] was submitted and reviewed. At the conclusion of said hearil after consideration of all evidence presented, the Planning Commission found the following facts and reasons to exist: 1. The proposed development is compatible with surrounding land uses because: a. Proper and safe vehicular access is being provided b. The development will not significantly impact resic tial uses in the area; c. The project area is buffered from surrounding resic by the freeway to the west, and a large fenced pla: ground to the east. 2. The proposed development is consistent with the General Plan because the land use designation for the subject s. is "Professional and Related". 3. The application is consistent with applicable City Pub1 Facilities policies and ordinances. All public facilit are available except sewer. The site has been approved a septic system to service the 10,000 square feet of of: space proposed for the initial development phase. WHEREAS, the Planning Commission, by the following vote approved SDP 78-4, subject to certain conditions: 1. Development of the site shall occur substantially as shc on the Site Development Plan for SDP 78-4, labeled Exhi; A, dated April 3, 1979, and elevation plan for SDP 78-4 labeled Exhibit B, dated April 9, 1979,.,-b0+? on file in Planning Department. The applicant shall consolidate the two lots within the Phase One boundary area prior to issuance of building pr 3. Prior to the issuance of building permits, the applicanl submit landscape and irrigation plans to the Planning Department for review and approval. 4. All landscaping and irrigation shall be installed prior occupancy. 5. The existing garage structure is to be removed prior to occupancy. The existing residence being utilized as an office must be brought up to current building codes to 1 satisfaction of the Building Director, prior to occupanc of the new structure. 6. Fire hydrants will be required to the satisfaction of tl Fire Marshall. 7. The applicant shall install street lights and sidewalks along the Pi0 Pic0 Drive frontage of Phase One of the p: to City standards and the satisfaction of the City Engi: 8. The applicant shall obtain the permission of the State t California Department of Transportation to discharge an: concentrated drainage onto the freeway right-of-way. 9. No signs or advertising of any type whatsoever shall be erected or installed until plans therefor have been app: by the City of Carlsbad. The provisions of Section 21. the Sign Ordinance, must be complied with prior to issu' of occupancy permits. 10. The applicant shall conform to all the conditions of thl San Diego County Health Department septic approval, datm November 16, 1978, unless City sewer capacity becomes available to service the project. 11. All buildings must conform to those height limitations set forth in the Building Code.
