PLANNING COMMISSION RESOLUTION. NO. 1517
A RZSOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL
OF AN AMENDMENT TO PUD-11, FOR A MINOR DEVIATION
FROM THOSE APPROVED PLANS, SUBSTITUTING DIFFERENT
BUILDING DESIGNS ON PROPERTY GENERALLY LOCATED ON THE
WEST SIDE OF EL CAMINO REAL BETWEEN CHESTNUT AND
TAMARACK AVENUES.

WHEREAS, on December 5, 1978, the City Council adopted
Resolution No. 5633, approving a Planned Unit Development pe
for four units on the subject property, more particularly
described as:
Lot 1 of Rancho Agua Hedionda, in the City of
Carlsbad, County of San Diego, State of California,
according to map thereof No. 923, filed in the
office of the County Recorder of San Diego County
November 5, 1896; and
WHEREAS,said property has subsequently been sold to the
applicant's firm, the Lendel Corporation; and
WHEREAS, on or about March 22, 1979, the applicant forw
a letter to the City of Carlsbad requesting three alteration
approved PUD-11; and
WHEREAS, on or about April 17, 1979, the applicant subm
a letter to the City of Carlsbad modifying his request of Ma
22, 1979, and requesting only one alteration to approved PUD
that of the substitution of applicant's building designs in
of those originally approved; and
WHEREAS, the Planning Director has determined that the
granting of this amendment to PUD-11, previously approved,
will have a non-significant impact on the environment as a

Negative Declaration has been filed for PUD-11, and the prop
alteration does not represent a significant material change
the findings and conclusions reached in that Negative Declar
and
WHEREAS, the Zone Code, Section 21.45.160, sets forth
procedures for accommodating amendments, which are minor in
nature, negating the necessity of a formal public hearing be
the City Council; and
WHEREAS, pursuant to the provisions of the Municipal Co
the Planning Commission did, on April 25, 1979, review said
proposed amendment to PUD-11, and after considering all evid
presented, found the following facts and reasons to exist:
1. The proposed amendment will not change the denisites or
boundaries of the subject property, or involve an addit
of a new use within the development.
2. Changes to approved yards, coverage, height, open space or landscaping, will not exceed ten percent.
3. The proposed building design is aesthetically pleasing, distinctive, tasteful, and comparable to the design ori approved.
WHEREAS, the Planning Commission, by the following vote
approved PUD-ll(A) with certain conditions:
1. That Exhibits A, B, C, D, and E, dated April 9, 1979, on file in the Planning Department, be incorporated as
approved plot plan and building elevations for PUD-11.
2. The building heights not exceed those contained on Exhi B, dated April 9, 1979, and that the pad elevations not from those originally submitted.
