HomeMy WebLinkAbout1979-05-23; Planning Commission; Resolution 1521>c /I w w 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1521 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT FOR TWENTY FOUR UNITS ON 1.13 ACRES OF PROPERTY LOCATED ON THE NORTH SIDE OF LA COSTA AVENUE, BETWEEN EL CAMINO REAL AND VIEJO CASTILLO WAY. CASE NO: CT 79-5/CP-4 APPLICANT: DUFFY, R. A. WHEREAS, a verified application for certain property, to wit: Lot 6 of La Costa Greens, in the City of Carlsbad, County of San Diego, State of California,,according to map thereof No. 6708, filed in the Office of the County Recorder of San Diego County, August 18, 1970. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reques provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commisison did on the 9th day of M 1979, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, the City of Carlsbad has prepared an Environmen Impact Assessment and a Negative Declaration (EIA Log No. 543 has been issued for the subject project, based on the followi 1. The subject property is already graded and devoid of any significant vegetation or wildlife. 2. The project is adjacent to existing urban development. 3. The proposed project is consistent with the adopted Carl General Plan and zoning designation of the subject site. WHEREAS, at said public hearing, upon hearing and consid' the testimony and arguments, if any, of all persons who desir, " il W 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 to be heard, said Commission considered all factors relating the tentative subdivision map (CT 79-5) and Condominium Permi. (CP-4) and found the following facts and reasons to exist: 1. The proposed project is consistent with existing zoning ( Residential Density-Multiple and with the General Plan since within the allowed density range of 20-30 dwelling units per ( 2. The project is consistent with all Public Facilities Pol and Ordinances because: A. Sewer service is available to this project because 1 applicant has received reservations for 12 sewer hookups Leucadia County Water District, and is on LCWD's allocat: list for an additional 12 EDUs, B. Fees to mitigate conditions of overcrowding of schoc facilities are required at the time of building permits pursuant to Chapter 21.55 of the Carlsbad Municipal Code C. A condition of approval is that park fees be paid. D. Access to developed public streets is assured. E. Water service will be provided by the Carlsbad Munic Water District. The applicant will be required to compl] with the rules and regulations of CMWD, F. All other facilities are available to service the project. 3. The site is physically suitable for the proposed developr because : A. Sufficient street access to and from the site alreac exists. B. The site is adequate in size and shape to accommodat the proposed development. C. The site is located next to a golf course which will provide a permanent adjacent open space, recreation and a desirable view. D. There will be no surface drainage problems, due to natural topography. 4. The proposed condominium development is consistent with t City of Carlsbad Environmental Protection Ordinance of 1972 because a Negative Declaration has been issued. // -2- w e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~ 5. The proposed condominium project meets the criteria of t Condominium Ordinance because: A. Storage space, laundry facilities, open recreation, refuse facilities, separate utilities, parking areas, an other requirements of Chapter 21.47 of the Carlsbad Zone Code have been provided in the proposed plans or will be made conditions of approval, B. The condominium meets the design criteria of the Condominium Ordinance because the overall plan is compre hensive, indicating inter-relationships of buildings, landscaping, natural topography, recreation areas, and surrounding property. WHEREAS, the Planning Commission, by the following vote, i approved CT 79-5/CP-4 subject to certain conditions: ~ 1. Approval is granted for CT 79-5/CP-4 as described in the applications, and any attachments thereto, as shown on the si plan for CT 79-5/CP-4, labeled Exhibit A, dated May 1, 1979, file in the Planning Department. 2. Final landscape and irrigation plans indicating recreati areas and facilities shall be submitted and approved prior to i suance of a Final Map. These improvements shall be installed I prior to final occupancy. ~ 3. All units shall be served with independent utility syster ~ and shall be separately metered in accordance with provisions of the Condominium Ordinance. 4. Water service shall be provided by the Carlsbad Municipa: Water District (CMWD). The applicant shall comply with the rules and regulations of the CMWD regarding water service to I dominiums. Should extensions to the existing public water sy: be deemed appropriate by CMWD, the developer will be required provide the complete system. 5. The developer will be required to pay park-in-lieu fees . City as required by the Director of Parks and Recreation prio: approval of the Final Map. 6. Storage space for each dwelling unit meeting requirements of the Condominium Ordinance will be indicated on building plans prior to approval of the Final Map. 7, The applicant will prepare a reproducible copy of the fir condominium site plan,incorporating all requirements of the condominium permit approval. This plan will be submitted and approved prior to approval of the final map. 8. The applicant will provide school fees to mitigate condit of overcrowding as part of building permit applications. Sewer permits from Leucadia County Water District for al: the proposed dwelling units must be presented to the Engineer; Department before a final map can be issued. 10. An on-site fire hydrant will be provided as shown on the plan, CT 79-5/CP-4 Exhibit A, dated May 1, 1979, on file in tl Planning Department. 11. The developer shall install a 5' sidewalk contiguous wit1 existing curb along the La Costa Avenue frontage to the satisj tion of the City Engineer prior to the occupancy of any of thc units . 12. The developer shall relocate the existing drainage inlet structure located within the proposed driveway appraoch to a ( location east of the driveway to the satisfaction of the San County Sanitation and Flood Control District and the City Eng 13. Prior to the final map approval, the developer shall pre to the City Engineer a letter of permission to grade and loca surface improvements within the San Diego County Sanitation a Flood Control Easement. 14, The developer must receive the approval of the City Engi for the improvement plans, enter into the appropriate improve agreement, and post the required security for the constructio public improvements prior to the recordation of the final map 15. The developer shall receive the approval of the City Eng for a site grading plan prior to any construction being perfo within the project site. 16. In order to provide for reasonable fire protection durin the construction phase, the subdivider shall maintain passibl vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended by Fire Department. 17. Street trees of a variety approved by the Parks and Recv Department shall be installed to City specifications at 40 fc intervals along the frontage of La Costa Avenue. 18. The structural section of the paved area for the north I- of the central circular drive shall be designed to accommodat the turning movements of fully loaded trash trucks to the sat faction of the City Engineer. 19. Pursuant to Government Code Section 66456.1 the Commissj hereby recognizes that the proposed project may be phased in parts, each consisting of 12 units, in accordance with CT 79- CP-4 Exhibit B, dated May 7, 1979, on file in the Planning Department. -4- . , .,' w 0 1 20.
