HomeMy WebLinkAbout1979-11-28; Planning Commission; Resolution 1564.. - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 I 21 22 23 24 25 26 27 28 i l e 0 PLANNING COMMISSION RESOLUTION NO. 1564 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO A SPECIFIC PLAN (SP-38) TO PROVIDE FOR AN OFF-SITE RECREATIONAL VEHICLE STORAGE YARD ON THE EAST SIDE OF CADENCIA STREET, LA COSTA. CASE NO. : SP 38-B/PUD-7 (A) APPLICANT: LA COSTA LAND COMPANY WHEREAS, a verified application for certain property, wit: Lot 472 of Carlsbad Tract No. 72-20, Unit No. 3, as filed in the Office of the County Recorder for San Diego County, June 3, 1974 has been filed with the City of Carlsbad, and referred to Planning Commission; and WHEREAS, said verified application constitutes a requ as provided by Title 21 of the Carlsbad Municipal Code; an WHEREAS, this project has been processed through envi mental review as required in Title 19, the Environmental P tion Ordinance. A Negative Declaration has been issued for the following reasons: 1) The project site is devoid of any significant flora o fauna, or any unique environmental or historical reso 2) The City's grading controls will adequately provide measures to mitigate potential adverse grading impact to the contiguous area. 3) Landscaping will be installed around the site and on slopes in order to lessen the project's visual impact and reduce erosion potential. WHEREAS, the Planning Commission did, on November 14, hold a duly noticed, public hearing as prescribed by law, consider said request: and // 1 .. - I/ e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 19 l8 ! 20 21 22 23 24 25 26 27 28 WHEREAS, at said public hearing, upon hearing and con- sidering all testimony and arguments, if any, of all person: desiring to be heard, said Commission considered all factors relating to the proposed amendment and found the following facts and reasons to exist: Findings 1) The proposed amendments do not substantially alter the originally approved PUD-7 and Specific Plan since the I storage area was originally approved in the same generz location and adequate storage area will be provided. 2) The San Diego Gas and Electric Company has found the proposed storage area to be an acceptable use within their transmission easement and has granted a license j the use of the property as proposed. 3) The overall design and location of the storage area provides for adequate circulation and sufficiently meets the storage requirements of Section 21.45.120(6) for planned unit developments. 4) Conditions have been included which serve to reduce thc overall visual impact of the proposed development. 5) An Environmental Impact Assessment (No. 556) has been processed and a negative declaration issued for the project. WHEREAS, the Planning Commission, by the following votc recommended approval of SP 38-B/PUD-7(A), subject to certair conditions: Conditions 1) Development shall occur substantially as indicated on Exhibits A and B dated 9/5/79, on file in the Planning Department, except for modifications required herein. 2) The applicant shall agree to modify the proposed landscape plans as follows: 15 Acacia Longifolia planted on 8 ft. centers shall be substituted for the Acacia Pycantha; one gallon Trachelospermum Jasminoide: planted on 18 in. centers shall be substituted for Grendelia Stricta. .2 .c - _. . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1.. 1 0 0 3) The applicant shall agree to provide a two foot landsc strip along the southern edge of the property, betweer the property line and the proposed fence. Said landsc strip shall be planted with the Acacia Longifolia as previously specified in Condition No. 2. Revised plar showing the proposed change shall be subject to the approval of the Planning Director prior to constructic 4) The applicant shall agree to install an eight foot hi? wall or fence around the entire perimeter of the stor; area. Said fence shall be constructed so as to parti; screen views of the storage area. 5) The RV storage area shall be limited solely for the us and convenience of the residents of Corona La Costa (PUD-7) . 6) The maintenance, restoration and/or repair of any recreational vehicle shall not be permitted within the storage area. 7) The applicant shall enter into a secured agreement wii the City of Carlsbad which guarantees that in the eve] that the license for the RV storage area is terminate( an alternative location, equivalent in size and accep- to the City, and the Planning Commission, shall be provided. This agreement must be drawn subject to thc approval of the Planning Director and secured prior tc approval of the final resolution on November 28, 1979 Construction shall be completed on the proposed projel within six months of the adoption of the approving resolution.
