A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A
SITE DEVELOPMENT PLAN FOR THE CONVERSION OF AN
EXISTING SINGLE FAMILY DWELLING AND DETACHED GARAGE
INTO PROFESSIONAL OFFICES ON PROPERTY LOCATED ON
THE SOUTHEAST CORNER OF KNOWLES AVENUE AND PI0
PIC0 DRIVE.
CASE NO. : SDP 79-5
APPLICANT: BAGLEY
WHEREAS, a verified application for certain property,
wit:
A portion of the northwest quarter of Section
6, Township 12 South, Range 4 West, San
Bernardino Meridian
has been filed with the City of Carlsbad, and referred to t
Planning Commission; and
WHEREAS, said verified application constitutes a requc
as provided by Title 21 of the Carlsbad Municipal Code; anc
WHEREAS, this project has been processed through envix
mental review as required in Title 19, the Environmental PI
tion Ordinance. A Negative Declaration has been
issued for the following reasons:
1) The subject property has been previously developed anc
devoid of any significant environmetal resources.
2) Very minimal land form alteration is being proposed il

order to prepare the site for development.
3) The project is consistent with all applicable plans,
and with the general developmental trend in the immed:
area.
WHEREAS, the Planning Commission did, on November 14,
consider said request; and

WHEREAS, upon hearing and considering
all testimony and arguments, if any, of all persons desirir:
to be heard, said Commission considered all factors relatir:
the Site Development Plan 79-5 and found the following fact
and reasons to exist:

1) The proposed project is consistent with the Land Use
Element of the City's General Plan since the site is
designated for professional and related commercial USE
2) At this time, the Planning Commission is not prepared to find that all other public facilities necessary to
serve the project will be available concurrent with ne The Planning Commission has, by inclusion of an appro- priate condition, required that the project contributc to the costs of such facilities. Since the developmer will pay its proportionate share of the public facilit

that the requirements of the public facilities element of the general plan have been satisfied.
3) The proposed development is compatible with the surro1: developments, both existing and proposed, since a simj
project (SDP 79-1) was approved on the property adjace
to the south, and sufficient measures have been taken reduce potential traffic and noise impacts along Know1 Avenue.
4) The proposal will not result in any significant adver: impacts since an Environmental 1m.pact Assessment has 1 processed for the project and a Declaration of NegatiL Environmental Impact has been made.
WHEREAS, the Planning Commission, by the following vot
to wit, approved Site Development Plan 79-5, subject to
certain conditions:

2) The applicant shall agree to plant additional drought
tolerant tree species (15 gallon size) within the fror
and side yards along Knowles and Pi0 Pico. A minimum
of six additional trees shall be planted, and delineat on the final site development plan.
3) Upon approval, the applicant shall submit a reproducil
copy of the Site Development Plan, incorporating all
of the requirements contained herein, subject to the approval of the Planning Director.
4) Prior to the issuance of building permits, the applicz
shall pay a public facility fee as established in Citl Council Policy No. 17. The applicant shall enter intc
a secured agreement with the City for the payment of
this fee prior to the issuance of building permits.
5) The applicant shall offer for dedication a strip of 12
10 feet wide adjacent to Knowles Avenue, running for t length of the property, prior to obtaining a building

registered civil engineer showing the proposed dedicat the new right-of-way line (with a 20 foot radius curvc at the intersection of Knowles Avenue and Pi0 Pic0 Bot and the area between this new right-of-way line and tl

6) The applicant shall be responsible for the constructic of public improvements, or shall enter into a future
agreement for the provision of such public improvemeni
as determined by the City Engineer. Said public
