HomeMy WebLinkAbout1980-01-09; Planning Commission; Resolution 15761 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 ti 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 1576 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A ZONE CHANGE FROM L-C (LIMITED CONTROL) TO P-U (PUBLIC UTILITY) AND F-P (FLOOD PLAIN OVERLAY) FOR A FIVE ACRE SITE LOCATED WEST OF RANCHO SANTA FE AT THE ENTRANCE TO SAN MARCOS CANYON CASE NO.: ZC 207 APPLICANT: La Costa Land Company and San Marcos County Water District WHEREAS, a verified application for certain property, to-wit : A parcel of land lying within the northeast quarter of Section 30, Township 12 South, Range 3 West, San Bernardino Meridian, in the County of San Diego, State of California has been filed with the City of Carlsbad, and referred to t' Planning Commission; and WHEREAS, said application constitutes a request as pro by Title 21 of the Carlsbad Municipal Code; and WHEREAS this project complies with the requirements of City of Carlsbad's Environmental Protection Ordinance of 19 and the State Environmental Quality Act, in that the projec has been processed through Environmental Review and the pro posed change of zone will not cause any substantial environ mental impacts, and an environmental impact report has been certified by the San Marcos County Water District for this project. Appropriate mitigating measures will be taken on subsequent actions to approve development of the site. WHEREAS the Planning Commission did on the 12th day of December, 1979, hold a duly noticed public hearing as presc by law to consider said request; and 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I WHEREAS, at said public hearing a staff report was presc and all persons desiring to speak on the subject zone change request were heard; NOW, THEREFORE BE IT RESOLVED, by the Planning Commissic the City of Carlsbad as follows: A. That the above recitations are true and correct. B. After consideration of all evidence presented at the pul hearing, the Planning Commission finds the following fa( and reasons to exist: 1) The proposed change of zone is consistent with the Gene] Plan since the P-U Zone specifically allos public facilities as indicated on the General Plan Land Use May 2) The P-U Zone requires a Precise Development Plan of development. Conditions may be placed on the Precise Development Plan to meet requirements of the General Plan or any other needs. 3) The site is physically suitable for the type of use sin( the site is adequate in size and shape to accommodate a sewer treatment plant. 4) The project is consistent with all City public facility policies and ordinances since the reactivation of this facility will provide sewer service in the service area, 5) The proposed change of zone will not cause any substant; environmental impacts, and an environmental impact rep01 has been certified by the San Marcos County Water Distr: for this project. Appropriate mitigating measures will be taken on subsequent actions to approve development oj the site. 6) The floodplain overlay zone will require an engineering report on impacts of construction on flooding.
