I 1 2 3 4 5 6 e a PLANNING COMMISSION RESOLUTION NO. 1585 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, APPROVING SITE DEVELOPMENT PLAN NO. 78-3 (B) ANENDW3NT TO THE SITE DEVELOPMENT PLAN TO RELOCATE THE MARKET AND A PARKING LOT ON PROPERTY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF LA COSTA AVENUE AND EL CAMINO REAL. CASE NO: SDP 78-3 (B) APPLICANT: WILLIAM BURNETT 7 8 9 WHEREAS, a verified application has been filed with the of Carlsbad, and referred to the Planning Commission: and 10 11 12 13 14 15 16 17 18 19 WHEREAS, said verified application constitutes a reques provided by Title 21 of the Carlsbad Ehnicipal Code; and WHEREAS, the Planning Commission approved Site Developm Plan 78-3 with Resolution No. 1501, dated March 28, 1979; an WHEREAS, pursuant to the provisions of the Municipal Co the Planning Commission did, on the 12th day of December, 19 considered a modification to approved Site Development Plan on property described as: ~ All those portions of Lot 9, together with that portion of the Southwest Quarter of the Southeast Quarter, all Section 35, Township 12 South, Range 4 West, San Bernar Meridian, in the County of San Diego, State of Californ I 20 WHEREAS, the City of Carlsbad has determined that SDP 7 21 Commission found the following facts and reasons to exist: 28 after considering of all evidence presented, the Planning 27 was submitted and reviewed. One condition requires proof of final approval of the system for the County Public Health Department. c) Gas and Electric service will be provided by SDG&E d) Water service will be provided by the Olivenhain Municipal Water District. e) All necessary on-site and adjacent public improver would be required as per the City's Public Improve Ordinance or as conditions of approval. f) At this time, all other public facilities necessar to serve this project will not be available concur with need. The Planning Commission has, by inclus of an appropriate condition, required that the pro contribute to the cost of such facilities. Since the development will pay for its proportionate sha of the public facilities which it will require, th Planning Commission is satisfied that the requiren of the public facilities element of the General P1 have been satisfied. WHEREAS, the Planning Commission, by the following vote approved SDP 78-3(B), subject to certain conditions: Conditions 1) Approval is granted for SDP 78-3 (B) as shown on Plannin Commission Exhibit "A", dated 11/13/79, On file in the Planning Department and incorporated by reference. Development shall occur substantially as shown on this exhibit unless otherwise noted in these conditions. 2) All conditions of SDP 78-3 and 78-3(A) (Planning Commis Resolution No. 1524) are still in effect, except as otk wise noted herein. 3) Condition No. 13 of Planning Commission Resolution No. is unenforceable and is therefore deleted. Any future subdivision maps on this parcel shall include access ar parking easement agreements. P. C. This approval is expressly condition upon the applicant entering into a secured agreement tc secure payment of this fee prior to approval of the resolution for SDP 78-3(B) by the Planning Commission. 6) The applicant shall provide evidence that the septic sy has been approved by the County Department of Public He or shall provide evidence of sewer availability prior t issuance of building permits.
