A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, APPROVING
A CONDITIONAL USE PERMIT TO ADD A DRIVE-THRU
TO A BANK LOCATED ON THE SOUTHEASTCORNER OF
HOSP WAY AND EL CABTINO REAL.

WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Codc
the Planning Commission did, on the 27th day of February, 198(

WHEREAS, the subject property has complied with the requ:
ments of the City of Carlsbad's Environmental Protection 0rdi1

WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persor
desiring to be heard, said Commission considered all factors
relating to CUP-175.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A. That the foregoing recitations are true and correct.
B. That based on the evidence presented at the public heari~
the Commission finds the following findings and conditio]
to exist:
Findings
1) The proposed project is desirable for the community and
is not detrimental to existing or proposed uses permittec
in the zone because:
a) The project has been adequately screened through
landscaping and fencing.
b) The use will be part of an extension of the commerc:
center to the north.
2) The proposed project is consistent with the land use
designation of Professional and Related Commercial.
3) The project is consistent with the Public Facilities EleI
of the General Plan because:
a) 15 edu's have been granted through the second phase
sewer allocation.
b) All necessary on-site and adjacent public facilitie!
are existing or will be required as conditions of
approval.
c) The applicant has agreed and is required by the
inclusion of an appropriate condition to pay a
public facilities fee. Performance of that contracl
and payment of the fee will enable this body to
find that public facilities will be available
concurrent with need as required by the general plar
d) The Planning Commission has, by inclusion of an
appropriate condition, insured that the final map for each phase shall not be approved unless the City Council finds that sewer service is available to serve the project. In addition, a

condition has been added requiring that a note be
placed on the final map that building permits may not be issued unless the City Engineer determines that sewer service is available.
Since the final map cannot be approved unless
sewer service is available, the building cannot occl within the project unless sewer service remains available, the requirements of the public facilitie:

4) The site for the intended use is adequate in size and sh;
to accommodate the drive-thru lane without disrupting the
traffic flow in the parking lot.

6) The street system is adequate to handle all traffic from the proposed drive thru because the use is adjacent to El Camino Real and access to El Camino Real will be by way of a signalized intersection at Hosp Way.

shall be used to screen the drive through lane of Wells
Fargo Bank and the parking area located south of
building nine adjacent to El Camino Real. Said wall may
be segmented to provide for an aesthetic design and effec visual screen. Said screening shall be shown on the detailed landscape and irrigation plan required as part of Site Development Plan No. 77-2(B),
3) This Conditional Use Permit is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available
at the time of application for such permits and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not available, building permits will not be issued.

6) All roof mounted equipment, including heating, ventilati
and air conditioning shall be self screened from public
right-of-ways and adjacent properties. Further, all plumbing, electrical, mechanical ductwork and other re12
equipment utilities shall be within the building and not
run on the roof. All connections to related roof mount€
equipment should occur within the same roof opening.
7) This approval is expressly conditioned on the payment by the applicant of a public facilities fee as required by
City Council Policy No. 17, dated August 29, 1979, on fi
with the City Clerk and incorporated herein by reference and according to the agreement executed by the applicant for payment of said fee. A copy of that agreement, date January 4, 1980, is on file with the City Clerk and incorporated herein by reference. If said fee is not pa as promised, this application will not be consistent wit the general plan and the project cannot proceed and this
approval shall be void.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held
on the 12th day of March, 1980, by the following vote, to wit
AYES: Schick, Marcus, Leeds, Larson and Jose.
NOES : None.
