APPLICANT: CITY OF CARLSBAD CASE NO: ZCA-123 OVERLAY ZONE, WHICH WOULD PERPTIT P4OBILE HOME WHEREAS, the Planning Commission did, on the 23rd day oJ April, 1980, hold a duly noticed public hearing as prescribec by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consic all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating the Zone Code Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hear: the Commission recommends APPROVAL of ZCA-123, accordin? to Exhibit "A" dated April 1, 1980, attached hereto and made a part hereof, based on the following findings: Findings : 1. It is desirable to have a mobile home park zone to provide locations where mobile homes may be established, 2. To provide a means to regulate and control of conversior of existing mobile home parks to another use. 3. To promote and encourage orderly residential environmeni for mobile home parks. 4. Implement the goals and objectives of the general plan, especially the housing element. 5. This project will not cause any significant environment? impacts, and a Declaration of Negative Environmental Iml has been issued by the Planning Director on March 10, l! Definition: Add the following definitions: 21.04.060 Building. "Building" means any structure having a roof, except all forms of vehicles. As used in this title, building includes factory built housing, but does not include mobile homes. Where this title requires, or where special authority granted pursuant to this title requires that a use shall be entirely enclosed within a building, this definition shall be qualified by adding "and. enclosed on all sides." 21.04.267 Mobilehome. A structure transportable in one or more sections, designed and equiped to contain not more than two dwelling units to be used with or without a foundation system. Mobilehome does not include a recreationa vehicle, commercial coach, auto trailer or factory built housing. 21.04.268 Mobilehome Lot. A portion of a mobilehome park designated or used for the occupancy of one mobilehone. 21.04.269 Mobilehome Fark. An area or tract of land where 2 or more mobilehome lots are rented or leased or owned as an approved planned unit development lot or owned in common as part of a condoninium corporation to accommodate mobilehomes for human habitation; provided that mobilehome park does not include: (a) premises for inspection and sale; (b) premises on which there is one trailer coach occupied by the owner thereof pursuant to a valid temporary occupancy permit issued by the Department of Fublic Eealth on which all trailer coaches are used exclusively either to provide farm employee housing or as a farm labor camp. SECTION 2. Name of Zone: Ad-d the following name of zone to Section 21.05.010 as follows: "MHP - Fobile Home Fark Overlay Zone" SECTION 3. Add Chapter 21.37 as the Mobilehome Park Overlay Zone as follows: Section 21.37.010 Intent and Purpose. The intent and purpose of the XHP, !lobilehone Park Overlay Zone is to: 1. A<. . 0 a Section 21.37.020 Application. "It is intended that the MHP Overlay Zone shall be placed on residential or planned community zone property, used or proposed for use as a mobilehome park. '' Section 21.37.030 Location of Mobilehomes. Occupied mobile homes shall be located only on land containing the Mobile Home Park Overlay Zone, unless especially approved through other provisions of this code. Section 21.37.040 Permitted Uses and Structures. Only the following uses are permitted on land containing the Mobile Home Park Overlay Zone. 1. Mobile Eome Parks. 2. Accessory buildings. 3. One identification sign for each entrance. This sign shall not have a height exceeding 4 feet or an area exceeding 50 square feet. condominiums or Mobile Home Park Planned Unit Developments. 4. Mobile Home projects may include Mobile Home Park Section 21.37.050 Conditional Use Permit Required. No permit or other entitlement shall be issued for anv use - permitted by Section 21.37.030 nor shall any such use be established until a conditional use permit thereon has been issued pursuant to this title. 2. ~~ Section 21.37.060 Exception. The following uses or structures are excepted from the conditional use permit requirements: 1. Mobile Home Parks processed as a condominium or a Flanned unit development. 2. Accessory buildings less than 400 square feet in area, awnings, carports, and other similar accessory structurc Section 21.37.070 Density. The number of mobile homes in a mobile home park shall not exceed the number of dwellinq - units permitted by the underlying zone and the general plan. Section 21.37.080 Yimimum Area. The minimum area of a mobile home park shall be two acres. Section 21.37.090 Development Standards. Development standards for mobile home parks shall be established by the City Council mobile home park development standards policy adopted by City Council resolution. The removal of the Nobile Home Park Overlay Zone may be accomplished by application of a Change of Zone as set forth in Chapter 21.52 of this code. Before approving said removal, in addition to any other requirements, the City Council shall find that: 1. The removal of the MHP zone is consistent with the Housing Element of the General Plan, will not adversely impact the city's lob7 to moderate incone housing stock, and will not be detrimental to the public health, safety and welfare of the community. 2. For property containing a ?lobile Home Park, that a phase-out plan has been prepared. Plans to mitigate impacts on families or individuals who will be displaced as a result of the phase-out program, including an outline of the proqramE that will be used to assist in the relocation of the families or individuals shall be included. The phase-out plan when approved by the City Council shall be made a condition of approval. SECTION 4. Conditional Use Permit. Amend Section 21.42.010(; - Uses Pernitted by Conditional Use Permit as follows: I' (G) Mobile home parks, (permitted in the Jlobile Home Park Overlay Zone only)." SECTION 5. Add to Section 21.45.010, Intent and Purpose of the PUD regulations as follows: "(6) Provide a means to create a mobile home park having separately owned. mobile h0m.e lots through land division.
