A RESOLUTION OF THE PLANNING CO!/IP/IISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE DEVELOPMENT PLAN NO. 80-2, FOR A PROFESSIONAL
OFFICE COMPLEX ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF ELM AVENUE APPROXIMATELY 110'
WEST OF HIGHLAND AVENUE.
APPLICANT : McCOY
CASE NO: SDP 80-2 ~.
WHEREAS, a verified application has been filed with the
City of Carlsbad, and referred to the Planning Commission; ar
WHEREAS, said verified application constitutes a request
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Cod
the Planning Commission did, on the 23rd day of April, 1980,
consider said request on property described as:
Portion of Tract 119 of Carlsbad Lands, County of
San Diego, State of California, Xap No. 1661, filed
Plarch 1, 1915
WHEREAS, at said hearing, upon hearing and considering 2
testimony and arguments, if any, of all 9ersons desiring to
be heard, said Commission considered all factors relating to
Site Development Plan No. 80-2.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
, B) That based on the evidence ?resented at the hearing, thc
following findings and subject to the following conditic
~ Commission recommends APPROVAL of SDP 80-2, based on the
Findings:
1) The site is physically suitable for the type, density ar design of the development since the property is adequate in size and topography to accommodate the project and st meet all city regulations without any significant
environmental impacts.

2) The project is consistent with all city public facility policies and ordinances since:
a) The applicant has been allocated sufficient sewer hookups for the project.
b) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a pub1 facilities fee. Performance of that contract and
payment of the fee will enable this body to find th
public facilities will be available concurrent with
need as required by the General Plan.
c) All necessary public improvements have either been provided or will be required as conditions of appro1

Element and all other applicable elements of the General
Flan.
5) The proposed development as conditioned is consistent wil
surrounding development, both existing and future.
Conditions
1. Approval is granted for SDP 80-2, as shown on Exhibit(s)
B & D, dated 2/22/80, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions.
2. This project is approved upon the express condition
that building permits will not be issued for developments
of the subject property unless the City Engineer determir
that sewer facilities are available at the time of
application for such sewer permits and will continue to
be available until time of occupancy.

3. This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August
29, 1979, on file with the City Clerk and incorporated
herein by reference, and according to the agreement
executed by the applicant for payment of said fee a
copy of that agreement dated 3/11/80, is on file with
the City Clerk and is incorporated herein by reference.
If said fee is not paid as promised, this application
will not be consistent with the General Plan and
approval for this project shall be void.
4, The applicant shall prepare a revised site plan incor-
porating the conditions of approval contained herein. Said site plan shall be submitted to and approved by the Planning Department prior to the issuance of buildin'
permits.
5. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and? approved
by the Planning Department prior to issuance of building permits. Said plan shall include berming of the landsca: area along Elm Avenue.
6. Parking lot trees shall be a minimum 15 gallon size.
7. A uniform sign program for this development shall be
submitted to the Planning Department for their review
and approval prior to occupancy of any building.
8. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from
view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Depart- ment, Building Department and Fire Department.
9. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and Policies
and all other applicable city ordinances in effect at ti1
of building permit issuance.
10. All driveway aisles shall have a minimum width of 25'.
11. The two northerly most parking spaces facing Building C
and the two northerly most parking spaces facing Buildins
A (i.e., those spaces closest to Elm Avenue) shall be
removed and replaced with landscaping.
12. A triangular area measured 25' from the curb radius alons Elm Avenue and the entrance driveway shall be landscaped with low growing shrubs and flowers so that visibility i: not impeded to traffic entering or exiting the developmer

13. The parking spaces facing north fronting Building A and those facing south against the rear property line shall be realigned so that the parking stalls do not encroach into the 10 foot side setback, and so that a 4 foot back up space is provided.
14. All landscape planters in the parking areas shall be 4 feet minimum in width and enclosed by a 4" to 6" PCC
curb.
15. Two trash enclosures, each containing two bins shall be
provided on the site. Location of these enclosures
shall be subject to the Planning Cirector's approval and shown on the revised site plan required by Condi- tion No. 4. Said trash enclosures shall consist of a 6 foot high masonary wall with gates pursuant to city
standards,
16. The applicant shall obtain a reciprocal access agreement
between the two parcels. Said agreement shall be submit.
to and approved by the City Engineer prior to final map
approval.
17. The applicant shall install a fire hydrant on Elm Avenue
to be located per requirements of the Fire Marshall. Sa. hydrant location shall be approved by the Fire Marshall : to final map approval.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held
the 23rd day of April, 1980, by the following vote, to wit:
