I <, . *r i t 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 e a PLANNING COP~'D1ISSION RESOLUTION NO. 1630 A RESOLUTION OF TEE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, EZECOP4MENDIPjG TITLE 21, CEAPTER 21.47, OF THE CARLSBAD MUNICIPAL CODE BY THE AI~'IEND?.XENT OF SECTION 21.47.130 TO PROVIDE FOR SPECIAL SETBACK APPROVAL OF A ZONE CODE ANENDEIENT, AI'IENDING CONSIDERATIONS FOR CONDOMINIUL!S APPLICANT: CITY OF CARLSEAD CASE NO: ZCA-121 WHEREAS, the Planning Commission did, on the 14th day of Play, 1980, hold a duly noticed public hearing as prescribed b law to consider said request; and WHEIIEAS, at said public hearing, upon hearing and consid all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating the Zone Code Amendment. NOW, THEREFORE, BE IT KEREBY F3SOLVED by the Planning Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public heari the Commission recommends APPROVAL of ZCA-121, according Exhibit "A" dated April 9, 1980, attached hereto and mad a part hereof, based on the following findings: Findings 1. The project will not cause any significant environmental impacts, and a Declaration of Negative Environmental Imp has been issued by the Planning Director on 4/24/80 , Log No. 6g2 . 2. Reducing setback requirements from private driveways wil provide more flexibility in condominium design. 3. The proposed setback will permit space for proper vehicl turn radius, pedestrian ways, landscaping anZ buffer. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.47, OF THE CARLSBAD EIUNICIPAL CODE BY THE AMENDMENT OF SECTION 21.47.130 TO PROVIDE FOR SPECIAL SETBACK CONSIDERATIONS FOR CONDOMINIUMS 6 ll The City Council of the City of Carlsbad, California, doc 7(/ ordain as follows: 8 SECTION 1: That Title 21, Chapter 21.47, Section 21.47.: 9 of the Carlsbad Municipal Code is amended by the amendment of 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 Subsection (1) (B) and by the addition of Subsection (1) (D) to read as follows: I' (1) (D) Building setbacks from private driveways shall 1 be less than five feet, except garages entered directly from. private driveway may either be set back five to seven feet or greater than twenty feet. Automatic door openers and inside opening doors may be required as a condition of approval if ' determined to be desirable to reduce traffic congestion and 1 maximize safety. (1) (D) The following intrusion may project into the req setback from driveways but in no case shall such intrusions e: more than two feet into such setback: cornices, belt courses sills, buttresses, and other similar architectural features; fireplace structures or chimneys; and fire escapes, and open porches. Open balconies and eaves extending from floors abovl first floor may intrude into the setback from driveway providl that such balconies do not extend over the driveway. No intr. into the required setback shall be allowed if that intrusion , or in combination with any other intrusion, inhibits traffic circulation, or provision of safety, sanitary or other servicl or is not compatible with the design of the project."
