HomeMy WebLinkAbout1980-05-28; Planning Commission; Resolution 1640m e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 l8 I 19 I 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1640 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERTIIT TO REPLACE AN EXISTING BUILDING AT THE CHURCH FACILITY GENERALLY LOCATED ON THE NORTHEAST CORNER OF CHESTNUT AVENUE AND MONROE STREET. APPLICANT: PILGRIM CONGREGATIONAL CHURCH CASE NO: CUP-85 (A) WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code the Planning Commission did, on the 28th day of May, 1980, hol duly noticed public hearing to consider said application on property described as: A portion of Tract 255 of Thum Lands, in the County of San Diego, State of California, according to Map Thereof No. 1681, filed in the Office of the County Recorder December 9, 1915. WHEREAS, at said public hearing, upon hearing and conside all testimony and arguments, if any, of all persons desiring t heard, said Commission considered all factors relating to CUP- NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearir the Commission recommends APPROVAL of CUP-85(A), based or following findings and subject to the following conditior Findings : 1) That the Planning Commission has previously found the USE be desirable to the development of the community and essentially in harmony with the various elements and obje of the general plan; in that they have previously approve CUP-20 and CUP-85. =. - II m 0 " 1 2 3 4 5 6 7 a 9 LO 11 12 13 14 2) That the amendment is not detrimental to existing uses or to uses specifically permitted in the zone because the ne building will replace one existing and both the building and parking area will be screened from surrounding proper 3) That the site is adequate in size and shape to accommodat the use because the new building will be constructed on t site of the existing building and additional parking prov 4) That all of the yards, setbacks, walls, fences, landscapi and other features necessary to adjust the requested use existing or permitted future uses in the neighborhood wil provided and maintained because the new building and park lot will not be constructed in any required yard and will screened by landscaping and a block wall. 5) That the street system serving the use is adequate to pro handle all traffic generated because the project is serve two fully improved collector streets and the amendment wi not generate additional traffic. 6) That the project is consistent with all city public facil policies and ordinances because the project is exempt fro public facility fees per Section 7(b) of City Council Pol No. 17 and the City Engineer has determined that no incre in sewer demand will be required. 15 16 7) That the Planning Director has determined that the projec is exempt from the provisions of the Environmental Qualit Act of 1976, per Section 19.04.090 of the Environmental Protection Ordinance. I'i' IIConditions : 18 19 20 21 22 23 1) Approval is granted for CUP-85(A), as shown on Exhibits A & B, dated May 2, 1980, on file in the Planning Departm and incorporated by reference herein. Development shall substantially as shown on these exhibits unless otherwise noted in these conditions. 2) The applicant shall prepare a detailed landscape and irri plan which shall be submitted to and approved by the Plan Department prior to the issuance of building permits. 3) Parking lot trees shall be a minimum 15 gallon size. 24 25 4) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash and debri. 26 27 28 5) Approval of this request shall not excuse compliance with sections of the zoning ordinance and all other applicable city ordinances in effect at time of building permit issuance. //// PC RES0 #1640 -2- I1 c .. -. * I1 m m I. 2 6) This approval shall become null and void if building pern are not issued for this project within one year from the date of project approval. 3 7) This approval is subject to all conditions of Resolution 4 349, (CUP-20) and 918 (CUP-851, which are incorporated by reference herein. 5 PASSED, APPROVED AND ADOPTED at a regular meeting of the ' Planning Commission of the City of Carlsbad, California, held 7i1the 28th day of May, 1980, by the following vote, to wit: 8 9 10: 11 12 13 14 15 16 17 18 19 u 20 21 22 23 ;r AYES: Schick, Larson, Friestedt, Marcus, Leeds, Romboti Jose NOES : None ABSENT: None ABSTAIN : None ATTEST : ?./" , 1' ,I "\.
