A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
VARIANCE TO DELETE THE REQUIREMENT FOR A 6'
HIGH BLOCK WALL ALONG THE SOUTHERLY PROPERTY
LINE OF PROPERTY GENERALLY LOCATED ON THE SOUTH-
EAST CORNER OF EL CAMINO REAL AND HOSP WAY IN
THE R-P-Q ZONE.

WHEREAS, a verified application for certain property, to

Parcel 4 of Parcel Map No. 4838 - a portion of lots
4 and 5 of Fractional Section 32, Township 11 South,
Range 4 west, San Bernardino Meridian, in the City of
Carlsbad recorded June 18, 1976
has been filed with the City of Carlsbad, and referred to the

WHEREAS, said verified application constitutes a request
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 28th day of
1980, hold a duly noticed public hearing as prescribed by law
consider said request; and
WHEREAS, at said public hearing, upon hearing and conside
all testimony and arguments, if anyI of all persons desiring t
be heard, said Commission considered all factors relating to V

23 A) That the foregoing recitations are true and correct.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning

1) There are exceptional and extraordinary circumstances and conditions applicable to the property or to the intended that do not apply generally to the other property in the

2) That this variance is necessary for the preservation and
enjoyment of a substantial property right possessed by
other property in the same vicinity and zone, but which i
denied to the property in question.
3) That the granting of such variance will not be materially
detrimental to the public welfare and injurious to the pr
or improvements in such vicinity and zone in which the pr
is located, as indicated in the analysis section of the
staff report.
4) That the granting of such variance will not adversely aff the comprehensive general plan, as indicated in the analy
