I1 PLANNING COMMISSION RESOLUTION NO. 1645 2 3 4 5 6 7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SITE DEVELOPMENT PLAN NO. 80-6, FOR A 300 UNIT RESIDENTIAL PROJECT TO INCLUDE AN 86 UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF MELROSE AVENUE EXTENDED, BETWEEN CORINTIA STREET EXTENDED AND ALGA ROAD EXTENDED. APPLICANT : WOODWARD COMPANIES CASE NO: SDP 80-6 CONDOMINIUM PERMIT AND A 214 UNIT PLANNED UNIT 8 of Carlsbad, and referred to the Planning Commission; and 9 WHEREAS, a verified application has been filed with the ( LO WHEREAS, said verified application constitutes a request 11// provided by Title 21 of the Carlsbad Municipal Code; and 12 WHEREAS, pursuant to the provisions of the Municipal Cod1 l3 I considered said request on property described as: l4 the Planning Commission did, on the 11th day of June, 1980, 15 16 17 18 19 20 21 22 23 24 25 26 Those portions of the Northeast Quarter of Section 30 and the Southeast Quarter of Section 19, Township 12 South, Range 3 west, San Bernardino Meridian, County of San Diego, State of California. WHEREAS, at said hearing, upon hearing and considering a testimony and arguments, if any, of all persons desiring to b heard, said Commission considered all factors relating to Sit Development Plan No. 80-6. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission recommends APPROVAL of SDP 80-6, based on the following findings and subject to the following conditic 27 28 Findings: 1) The site is physically suitable for the type, density an 11 : ',.: II e e 1 2 design of the development since the property is adequate in size and topography to accommodate the project and stl meet all city regulations. 3 4 2) The project is consistent with all city public facility policies and ordinances since: 5 I! a) The applicant has been allocated sufficient sewer hookups for the project. 6 7. 8 9 10 11 12 13 14 15 16 b) The applicant has agreed and is required by the inc: of an appropriate condition to pay a public facilit: fee. Performance of that contract and payment of tl fee will enable this body to find that public facil: will be available concurrent with need as required I the General Plan. c) All necessary public improvements have either been provided or will be required as conditions of appro d) The Planning Commission has, by inclusion of an appropriate condition, insured that the project wil not be approved unless the City Council finds that sewer service is available to serve the project.
