HomeMy WebLinkAbout1980-06-11; Planning Commission; Resolution 1648J- -. ll 0 e 1 2 3 4 5 6 PLANNING COMMISSION RESOLUTION NO. 1648 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMP.IENDING APPROVAL OF AN 18 LOT PLANNED INDUSTRIAL DEVELOPMENT ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF YARROW DRIVE AND CORTE DE LA PINA. APPLICANT: BIRTCHER PACIFIC CASE NO: CT 80-27 I 7 11 WHEREAS, a verified application for certain property, to 8 9 Parcels A & B of Parcel Map No. 4713 being a resubdivisic of Lot 2 of Carlsbad Tract 73-49, Map No. 8054 in the Cit of Carlsbad, County of San Diego 10 11 has been filed with the City of Carlsbad, and referred to the Planning Commission; and 12 WHEREAS, said verified application constitutes a request l3 to consider said request; and l6 June, 1980, hold a duly noticed public hearing as prescribed b l5 WHEREAS, the Planning Commission did, on the 11th day of 14 provided by Title 21 of the Carlsbad Municipal Code; and 17 WHEREAS, at said public hearing, upon hearing and conside 18 Tentative Tract Map. 2o \heard, said Commission considered all factors relating to the l9 all testimony and arguments, if any, of all persons desiring t 21 26 following findings and subject to the following condition 25 B) That based on the evidence presented at the public hearin 24 A) That the above recitations are true and correct. Z3 mission as follows: 22 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Con Findings: 27 1) The proposed tentative map is consistent with the city's 28 general plan since the site is designated by the land use plan for planned industrial and, as conditioned, the proj is consistent with all other general plan elements. the Commission recommends APPROVAL of CT 80-27, based on '2 '- ' I! e e I. 2 2) The site is physically suitable for the type of developme1 3 without impacting surrounding property or any environment' proposed since the property can accommodate the project resources. 4 5 6 7 3) The design of the project will not cause any significant environmental impacts since based on an initial study of project, including a field investigation of the site, the Planning Director has determined that the project will no result in any adverse environmental impacts and therefore has issued a declaration of negative environmental impact May 14, 1980, Log No. 700. 8 9 10 11 12 4) The design of the subdivision will not cause any serious health problems since the project meets all public health requirements. 5) The project is consistent with all city public facility policies and ordinances since: a) Adequate sewer connections have been allocated for the project. In addition, septic systems have been approved for the site. l3 I l4 I b) Adequate water, gas and electric service will be ava to serve the development. 15 il c) All necessary public improvements will either be pro or required as conditions of approval. 16 17 l8 i 19 I d) The applicant has agreed and is required by the incl of an appropriate condition to pay a public faciliti fee. Performance of that contract and payment of th fee will enable this body to find that all other pub facilities will be available concurrent with need as required by the general plan. 2o /1 Conditions 21 22 23 24 3) This approval is expressly conditioned on the payment by applicant of a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file wit 1) Approval is granted for CT 80-27 as shown on Exhibit F to CT 80-27/PUD-19 dated June 5, 1980, on file in the Planni Department and incorporated by reference. 2) All conditions of approval of Resolution No. 1649 for PUD and Resolution No. 6009 for CT 79-14 shall be met. 25 I 26 27 the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee. A copy of that agreement, dated Mar 1980, is on file with the City Clerk and incorporated her 28 by reference.
