A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SITE DEVELOPMENT PLAN NO SDP 80-3, TO DEVELOP A BUILDING OFFICE AND TELEVISION STUDIO FACILITY ON PROPERTY GENERALLY
LOCATED ON THE EAST SIDE OF EL CAMINO REAL,
NORTH OF PALOMAR AIRPORT ROAD.
APPLICANT: DANIELS CABLEVISION

WHEREAS, pursuant to the provisions of the Municipal Code 11
WHEREAS, said verified application constitutes a request 49
WHEREAS, a verified application has been filed with the C

Parcel B of Parcel Map No. 1703, filed in the Office of
County Recorder of San Diego County, July 6, 1973, being
a portion of Lot 3 of Rancho Agua Hedionda, according to
Map thereof No. 823, filed in the Office of County Recore
of San Diego County, November 16, 1896.
17 WHEREAS, at said hearing, upon hearing and considering a1

21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning

2) That the project is consistent with all city public facil
policies because adequate sewer connections have been all for the project and the applicant has agreed and is requi by the inclusion of an appropriate condition to pay a pub facilities fee. Performance of that contract and payment the fee will enable this body to find that all other pub1
facilities will be available concurrent with need as requ
by the General Plan.
7 3) That the site is physically suitable for the type of deve
ment proposed since the property can accommodate the proj
without impacting surrounding property or any environment
resources. a
9 4) That the proposed project is compatible with surrounding

developments, both existing and proposed, because landsca
screening will be required as a condition of approval and buildings will be setback from property lines.

5) The design of the project will not cause any significant
environmental impacts since based on an initial study of
project, including a field investigation of the site, the
Planning Director has determined that the project will nc
result in any adverse environmental impacts and therefore
has issued a declaration of negative environmental impact
June 11, 1980, Log No. 711.

1) Approval is granted for SDP 80-3, as shown on Exhibit(s) dated 6/16/80, and Exhibits "Bll and "C", dated 6/19/80,
incorporated by reference and on file in the Planning
Department. Development shall occur substantially as shc unless otherwise noted in these conditions. 19 I

2) This project is approved upon the express condition
that building permits will not be issued for developments
of the subject property unless the City Engineer determir
that sewer facilities are available at the time of application for such permits and will continue to be available until time of occupancy.

3) The applicant shall prepare a reproducible mylar of the
25
contained herein. Said site plan shall be submitted to
final development site plan incorporating the conditions
and approved by the Planning Department prior to the issuance of building permits.
26 4) This project is approved upon the express condition

that the final Site Development Plan shall not be approve
unless the City Council finds as of the time of such appl
that sewer service is available to serve the subdivision,

5) This project is approved upon the express condition that
the applicant shall pay a public facilities fee as requil
by City Council Policy No. 17, dated August 29, 1979, on
file with the City Clerk and incorporated herein by
reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated June 19, 1980, is on file with the City (
is incorporated herein by reference. If said fee is not
paid as promised, this application will not be consistenl
with the General Plan and approval for this project shal:
be void.
6) The applicant shall dedicate a 14' wide easement for strc purposes along the southern property line. The dedicatic
shall include a 20 foot property line radius at the soutl:
corner of the subject property. The deed for this easemt
shall be recorded prior to the issuance of building perm: and the dedication shall be free and clear of any liens ( encumbrances.
7) In the event that Beckman Instruments is able to acquire for dedication west of their property and south of the
existing entrance road, the applicant shall dedicate an c width of land for street purposes north of the entrance 1 along the eastern edge of the subject property. In no eT shall the width of this dedication exceed 36 feet (half 1
street width). This condition shall not delay the issual of a building permit.
8) The applicant shall construct half street improvements (I on a half street right-of-way width of 42 feet) to city standards on the land abutting the southern edge of the subject property. All improvements shall be constructed to occupancy of any additional buildings.
9) Plans for the street improvements shall be submitted to . City Engineer for approval and bonds posted prior to the issuance of a building permit.
10) Street trees of a variety approved by the Parks and Recrc Director shall be installed to city specifications at 40 foot intervals along all public street frontages or a!
otherwise approved by the Planning Director.
11) The applicant shall prepare a detailed landscape and
irrigation plan which shall be submitted to and approved by the Planning Department prior to building permits.
12) Parking lot trees shall be a minimum 15 gallon size.
13) Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval by the Planning Department prior to installation of such signs.

14) In order to provide for fire protection during the
construction period, the applicant shall maintain passab:
vehicular access to all buildings. In addition, adequatc
fire hydrants with required fire flows shall be installec on and off site as required by the Fire Department.
15) A uniform sign program for this development shall be
submitted to the Planning Department for their review
and approval prior to occupancy of the building.
16) Trash receptacle areas shall be enclosed by a 6 foot higl
masonry wall with gates pursuant to city standards.
Location of said receptacles shall be approved by the Planning Department.
17) All roof appurtenances, including air conditioners, shal:
be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building Department.
18) Approval of this request shall not excuse compliance wit1
all sections of the Zoning Ordinance and all other
applicable city ordinances in effect at time of building
permit issuance.
19) The developer shall receive the approval of the City
Engineer for a site grading plan and obtain a grading
permit prior to issuance of building permits.
20) Grading shall occur in accordance with an approved gradil and erosion control plan, city standards, and an approvec soils and geologic investigation report which shall incll slope stability calculations and construction specificat
All exposed slopes shall be hydromulched or otherwise
stabilized prior to the issuance of building permits sub,
to the approval of the City Engineer.
21) Drainage improvements shall be constructed in accordance
with an approved plan, and the work shall be coordinated
with the overall plan for grading to the satisfaction of
the City Engineer.
22) The applicant shall redesign the proposed building, to cc
with conditions of dedication, to the satisfaction of thl
Planning Director. This revision shall be incorporated
and approved on the final Site Development Plan.
23) All lighting shall be so arranged as to reflect away fro] adjacent and surrounding properties.
24) If a satellite wastewater treatment facility is subseque: approved to serve this area, dual water systems shall be
installed for the maintenance of landscaping with reclaii water per the requirements of the City Engineer.
