HomeMy WebLinkAbout1980-07-23; Planning Commission; Resolution 1652.- ,- -* ll e e II PLANNING COMMISSION RESOLUTION NO. 1652 1 2 3 4 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF SP-180, FOR A 558.6 ACRE INDUSTRIAL PARK GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL, NORTH OF PALOMAR AIRPORT ROAD. APPLICANT: KOLL COMPANY CASE NO: SP-180 5 11 WHEREAS, a verified application for certain property, to 6 7 8 9 10 Those portions of Lots IrF" and "G" of Rancho Agua Hedionc part in the City of Carlsbad and part in the unincorporal area of the County of San Diego, State of California, according to the partition map thereof No. 832, filed in the Office of the County Recorder of such County, Novembc 16, 1896 llhas been filed with the City of Carlsbad and referred to the 11 Planning Commission; and 11 WHEREAS, said verified application constitutes a request 12 13 14 provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 11th and 19tl IlOf June, 1980, and the 23rd day of July, 1980, hold duly notic 15 public hearings as prescribed by law to consider said request; WHEREAS, at said public hearing, upon hearing and considc 16 17 l8 I all testimony and arguments, if any, of all persons desiring 1 heard, said Commission considered all factors relating to the Specific Plan; and 19 I 20 21 Commission as follows: 22 A) That the above recitations are true and correct. 23 B) That based on the evidence presented at the public heari~ 24 the Planning Commission recommends that the City Council adopt an ordinance approving SP-180 based on the followil: findings and conditions: NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 25 I 26 //// I1 27 //// I/ 28 //// - - , I/ e e - ll 1 Findings I/ 2 3 4 5 6 7 8 9 10 11 12 13 14 l 15 1~ 1) The site is physically suitable in size and shape to accommodate the proposed uses because the Specific Plan provides standards for development which accommodate the project with the site. 2) The proposed uses will not be detrimental to adjoining properties for the reasons outlined in the staff report. 3) This project will not cause any significant adverse impac the environment because the mitigation measures of EIR 8( recommended for certification by the Planning Commission been incorporated into the Specific Plan. 4) The project is consistent with all city public facility I and ordinances because the Specific Plan prohibits any development on the site without the proper public improv 5) The specific plan is consistent with the Carlsbad Genera and with Sections 65451 and 65452 of the Government Code regulate the use of Specific Plans. ~ Conditions 1) Approval is granted for SP-180, for the area as shown on Figure 3, of the "Carlsbad Pacific Business Park Specifi dated July 18, 1980, incorporated by reference and on fi in the Planning Department. 16 2) All standards and provisions established in the document 18 Planning Commission at said public hearing, and incorpor dated July 18, 1980, including any changes made by the 17 entitled "Carlsbad Pacific Business Park Specific Plan," occurring within the boundaries of this Specific Plan. by reference, shall be met by any future development 19 ! 3) This project is approved upon the express condition that City Council Policy No. 17, dated August 29, 1979, on fj according to the agreement signed by the applicant for I on file with -the City Clerk and is incorporated herein 1 20 of said fee a copy of that agreement dated June 25, 198( 22 with the City Clerk and incorporated herein by referencc 21 applicant shall pay a public facilities fee as required 23 24 reference.
