APPLICANT: BLANKENSHIP CASE NO: CT 80-18 WHEREAS, a verified application for certain property to 7 Lot 1 of Parcel Map 428 in the City of Carlsbad, County of San Diego, State of California, filed in the Office 0: the County Recorder of January 20, 1971, as file No. 114' being a portion of Lot A, of Brentwood Village Map No. 4 recorded October 19, 1959. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 23rd day of July, 1980, hold a duly noticed public hearing as prescribed : law to consider said request; and WHEREAS, at said public hearing, upon hearing and consid' all testimony and arguments, if any, of all persons desiring be heard, said Commission considered all factors relating to the Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public heari the Commission recommends APPROVAL of CT 80-18, based on the following findings and subject to the following cond Findings: 1) That the subdivision is consistent with the city's gener plan because the proposed density would conform to the L e e 1 2 city's land-use designation of residential medium density Also, as conditioned, the project is consistent with all other elements of the general plan. 3 4 2) That the site is physically suitable for the type and den of development since the site is adequate in size and 5 topography to accommodate residential development at the proposed density and still meet all of the city's subdivi regulations. €I 3) That the project is consistent with all city public facil 7 policies and ordinances since: a 9 10: 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 ~ a) The City of Carlsbad has allocated 4 edu's to accom development of the property. The existing unit is presently served by the City of Carlsbad's Water Dis b) School facilities will be provided by the Carlsbad Unified School District. c) Payment of park-in-lieu fees has been made a conditi of approval. d) The applicant has agreed and is required by the incl of an appropriate condition to pay a public faciliti fee. Performance of that contract and payment of tk fee will enable this body to find that public facili will be available concurrent with need as required 1 the general plan. e) The Planning Commission has, by inclusion of an appr riate condition to this tentative subdivision map, insured that the final map will not be approved unlc the City Council finds that sewer service is availat to serve the project. In addition, the Planning Commission has added a condition that a note be plac on the fnal map that building permits will not be i: for the project unless the City Engineer determines sewer service is available. Since the final map car be approved unless sewer service is available, and building cannot occur within the project unless sew€ service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the General Plan have been me1 insofar as they apply to sewer service for this ten1 map approval. 25 1 14) That the design of the subdivision and all required imprc ments will not cause any significant environmental impaci since, based on an initial study and field investigation the site, the Planning Director has issued a negative 26 27 declaration on July 17, 1980, Log No. 728. 28 //// PC RES0 #1670 -2 - .I I ' ll e e I. 5) That the design of the subdivision and type of improvemer will not conflict with easements for public use or public 2 access through the subject property. 3 4 6) That the subdivision map satisfies all requirements of T: 20 and the Subdivision Map Act as referenced in the staf: report. !5 I/ Conditions: 6 7 1) Approval is granted for CT 80-18, as shown on Exhibit A, dated 7/1/80 and Exhibit B, dated 6/3/80, incorporated b: 8 reference and on file in the Planning Department. Devel1 9 in these conditions. shall occur substantially as shown unless otherwise notel 2) This project is approved upon the express condition that building permits shall not be issued for development of subject property unless the City Engineer determines tha sewer facilities are available at the time of applicatio for such sewer permits and will continue to be available time of occupancy. 10 11 12 13 14 3) This project is approved upon the express condition that final map shall not be approved unless the City Council as of the time of such approval that sewer service is av to serve the subdivision. I.5 4) 16 17 18 19 I 2o I This project is approved upon the express condition that applicant shall pay a public facilities fee as required City Council Policy No. 17, dated August 29, 1970, on fi with the City Clerk and incorporated herein by reference according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated Febru 24, 1980, is on file with the City Clerk and is incorpor herein by reference. If said fee is not paid as promise this application will not be consistent with the General and approval for this project shall be void. 21 22 23 24 25 26 27 28 5) The applicant shall prepare a detailed landscape and irr plan which shall be submitted to and approved by the Pla Department prior to final map approval. 6) The applicant shall pay park-in-lieu fees to the city, p to the approval of the final map as per Chapter 20.44 of city's subdivision regulations. 7) Approval of this request shall not excuse compliance wii sections of the Zoning Ordinance and all other applicabl ordinances in effect at time of Final Map approval. 8) For all grading in excess of 100 cubic yards, the applic shall receive the approval of the City Engineer for a si grading plan and obtain a grading permit. Grading shall in accordance with an approved grading and erosion cont~ plan and city standards. The applicant shall provide two off-strc parking spaces on Lot 1, per Exhibit "A". Said improvemt shall be installed prior to occupancy of any units.
