HomeMy WebLinkAbout1980-08-13; Planning Commission; Resolution 1669- /I e e I/ X II PLANNING COMMISSION RESOLUTION NO. 1669 2 3 4 5 6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOWTENDING APPROVAL OF A ZONE CHANGE FROM L-C (LIMITED CONTROL) TO CT-Q (COMMERCIAL TOURIST WITH A Q OVERLAY) ON PROPERTY GENERALLY LOCATED ON THE NORTHWEST CORNER OF PALOMAR AIRPORT ROAD AND PASEO DEL NORTE. APPLICANT: ECKE CASE NO: ZC-213 7 WHEREAS, a verified application for certain property, to 8 That portion of Lots G and H of Rancho Agua Hediona, Map 9 10 11 12 13 14 15 16 17 No. 823, County of San Diego, filed November 16, 1896. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provic by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 9th day of JI 1980, and the 13th day of August, 1980, hold a duly noticed pi hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considl 18 19 20 21 22 23 24 25 26 27 all testimony and arguments, if any, of all persons desiring be heard, said Commission considered all factors relating to Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public heari the Commission recommends APPROVAL of ZC-213, based on t following findings and subject to the following conditio Findings: 1) The proposed change of zone to CT-Q is consistent with t General Plan designation of TS for the reasons stated in the staff report. - 28 - ll e e II I. 2) The site is physically suitable for the type of uses allowed in the CT-Q zone for the reasons stated in the 2 staff report. 3 4 3) The applicant has agreed and is required by the inclusion an appropriate condition to pay a public facilities fee. 5 Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General 6 ll Plan. 7 4) The proposed change of zone will not cause any substanti? environmental impacts, and therefore, the Planning Direct has issued a Declaration of Negative Environmental Impact the project dated May 29, 1080, Log No. 707. a 9 10 11 12 13 14 15 16 17 18 5) The proposed change of zone is consistent with all other elements of the General Plan. Conditions 1) A change of zone from LC to CT-Q shall be for that propel as shown on Exhibit “All dated May 20, 1980. 2) 19 11 I This project is approved upon the express condition that the applicant shall pay a public facilities fee as requir by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by thc applicant for payment of said fee a copy of that agreemer dated June 11, 1980, is on file with the City Clerk and : incorporated herein by reference.
