I1 - 0. #I 1 2 3 4 5 6 7 PLANNING COMMISSIONS RESOLUTION NO. 1684 " " A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CON- DITIONAL USE PEFNIT TO OPERATE A PRIVATE CHRIS- TIAN JUNIOR & SENIOR HIGH SCHOOL AT THE CARLSBAD UNION CHURCH FACILITIES ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF PINE AVENUE, BETWEEN HARDING STREET AND JEFFERSON STREET IN THE R-3 ZONE. APPLICANT: VICTORY CHRISTIAN HIGH SCHOOL CASE NO: CUP-116 (A) 1 8 9 WHEREAS, a verified application has been filed with the C of Carlsbad and referred to the Planning Commission; and 10 11 12 13 14 15 16 17 WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad J!lunicipal Code, and WHEREAS, pursuant to the provisions of the Municipal Code the Planning Commission did, on the 27th day of August, 1980, a duly noticed to consider said application on property descri as: Lots 1, 2, 3, 4, 5, 6, 21, 23, 24, 25, 26, 27, 28, 29, 31, 32, and 33 of Block 58 of town of Carlsbad amended, filed in Map 775, Book 365, Page 535 of Records of the County of San Diego. l8 /all testimony and arguments, if any, of all persons desiring t I' 1 WHEREAS, at said public hearing, upon hearing and conside heard, said Commission considered all factors relating to CUP- 2o 21 (1116 (A) . 22 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Corn 23 sion of the City of Carlsbad as follows: 24 A) That the foregoing recitations are true and correct. 25 lB) That based on the evidence presented at the public hearin 26 the Commission recommends APPROVAL of CUP-llG(A), based o the following findings and subject to the following condi 27 11 // 28 // /I I *-- I/ w .. <. 1 Findings: 2 1) That the requested use is desirable for the development o the community and consistent with the objectives of the the educational opportunities and choices of the communit 3 4 General Plan because private education institutions expan' and the North County in general. 5 7 schools presently exist in the neighborhood and no struct 6 2) That the requested use would not be detrimental to. existi uses or uses specifically permitted in the zone because modifications to the facility are proposed. a 9 10 11 12 13 3) That the site is adequate in size and shape to accommodat the use because, as conditioned, adequate classroom space exists on-site, adequate recreation space is available in immediate vicinity and adequate parking is provided on-si and in the auxilliary lot. 4) That the features of the use such as yards, setbacks, wal fences, landscaping and parking necessary to make the reg use compatible with existing and permitted future uses wi be provided because the school will utilize existing chur facilities and conditions of approval will ensure provisi of parking and landscaping in conformance with city stand 14 5) That the street system is adequate to properly handle all serving' the project are fully improved with low traffic 15 traffic generated by the use because adjacent city street counts and can accommodate the slight increase in traffic 16 that would be anticipated by the continuation of this USE 17 Conditions: 18 1) Approval is granted for CUP-llG(A), as shown on Exhibit P dated January 15, 1976, incorporated by reference and on 19 ! in the Planning Department. 20 21 2) This Conditional Use Permit is granted to the Victory Chx transferable to others. tian Junior/Senior High School and is not assignable nor 22 23 24 25 26 3) Victory Christian Junior/Senior High School shall not cor educational classes after 6:OO PM. 4) The school shall be a closed campus. 5) No modifications shall be made to the on-site parking lot purposes of physical education activities which would imy the use of the lot for parking purposes during non-school hours . 27 6) Use of the on-site parking lot designated on Exhibit A fc between 7:30 AM and 9:00 PM. 28 Bhysical education activities shall be limited to the ho1 PC RES0 #1684 -2- I c N ..-' - I1 e 0 1 7j This CUP shall be reviewed by the Planning Director in fl years from the date of adoption of this resolution and a 2 report should be forwarded to the Planning Commission. I the use has caused any problems or if the Director feels 3 new conditions of operation are necessary or additional tions should be added, a new public hearing shall be con in a manner prescribed by law. 4 5 8) If the total student enrollment reaches 205 students, no tional students shall be permitted unless the applicant 6 requests and receives approval from the Planning Commiss for an amendment of this CUP. 7 PASSED, APPROVED AND ADOPTED at a regular meeting of the 8 Planning Commission of the City of Carlsbad, California, held 9 the 27th day of Aygust, 1980, by the following vote, to wit: 10 AYES: Schick, Larson, Marcus, and Jose.
