PLANNING COMMISSION RESOLUTION NO. 1693
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING A VARIANCE
TO ALLOW A BUILDING (WINDMILL TOWER) TO EXCEED
ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF PALOMAR AIRPORT ROAD AND PASEO DEL NORTE .
APPLICANT: PEA SOUP ANDERSEN’S

THE 35 FEET HEIGHT RESTRICTION OF THE C-T ZONE
WHEREAS, a verified application for certain property, tc
wit:
A portion of Lot H of Rancho Aqua Hedionda according to
map thereof No. 823 filed in the Office of the San Diego County Recorder, also known as assessor’s parcel numbers
211-021-13 and 211-021-14
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 10th day of
September, 1980, hold a duly noticed public hearing as prescr
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and consid
all testimony and arguments, if any, of all persons desiring
heard, said Commission considered all factors relating to V-3
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public heari
the Commission recommends DENIAL of V-310, based on the
following findings:

2) The variance is not necessary for the preservation and
enjoyment of a substantial property right. The property
can still be developed without the variance and the towe
can serve as an integral part of the design of the proje and as a landmark for the site and still comply with the
height limitations.
