APPLICANT: PEA SOUP ANDERSEN’S CASE NO: V-310 THE 35 FEET HEIGHT RESTRICTION OF THE C-T ZONE WHEREAS, a verified application for certain property, tc wit: A portion of Lot H of Rancho Aqua Hedionda according to map thereof No. 823 filed in the Office of the San Diego County Recorder, also known as assessor’s parcel numbers 211-021-13 and 211-021-14 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 10th day of September, 1980, hold a duly noticed public hearing as prescr by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consid all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to V-3 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public heari the Commission recommends DENIAL of V-310, based on the following findings: Findings : 1) There are no exceptional or extraordinary circumstances conditions applicable to the property since the lot is c regular size and shape, is subject to normal setback I) 0 4* 1 -q 1. t - c *' c 1 requirements and is visible from the freeway. 2 3 4 5 2) The variance is not necessary for the preservation and enjoyment of a substantial property right.
