APPLICANT : MALOY CASE NO: ZC-216 WHEREAS, a verified application for certain property, t wit: A portion of Lot 47 of Seaside Lands, according to map thereof No. 1722, filed and recorded July 28, 1921 has been filed with the City of Carlsbad, and referred to th Planning Commission: and WHEREAS, said application constitutes a request as prow by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 24th day of September, 1980, hold a duly noticed public hearing as presc by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consi all testimony and arguments, if any, of all persons desiring be heard, said Commission considered factors relating to the Zone Change: and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hear the Commission recommends APPROVAL of ZC-216, based on following findings and subject to the following conditi Fihdings: 1) That the Zone Change to R-P is consistent with the desi of RMH/O for this property in the Land Use Element of t General Plan. I1 il e I, : , ,-p /I 1 2 2) That the uses permitted by the R-P zoning are consisteni and compatible with other uses permitted in the area. 3) That the subject lot is adequate in size and shape to 3 accommodate uses permitted in the R-P zone. 4 4) That the zone change will not cause any significant env: mental impacts since based on an initial study of the 6 the Planning Director has determined that the project w not result in any adverse environmental impacts and the. has issued a declaration of negative environmental imp 5 project, including a field investigation of the site, 7 September 9, 1980, Log No. 750. 8 Condition,s: 9 1) 10 11 12 13 14 This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated July 24, 1980, is on file with the City Clerk and is incorporated herein by reference.
