PLANNING COMMISSION RESOLUTION NO. 17 05
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE CREATION OF TWO PANHANDLE LOTS AS PART OF A MINOR SUBDIVISION LOCATED ON THE SOUTH SIDE OF CHESTNUT AVENUE, BETWEEN HIGHLAND DRIVE AND VALLEY STREET IN THE R-1 ZONE.
APPLICANT: O'DAY 'CASE 'NO :' 'MS-460
WHEREAS, a verified application for certain property to
Parcel 2 of Parcel Map 2828 in the City of Carlsbad fil
July 8, 1974, in the San Diego County Recorder's Office
has been filed with the City of Carlsbad, and referred to th
Planning Commission; and
WHEREAS, said application constitutes a request as prov
by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Carlsbad Municipal Code, Section 21.10.080
provides that any panhandle lots within a minor subdivision
approved by the Planning Commission; and
WHEREAS, the Planning Commission did on the 8th day of
1980, hold a hearing as prescribed. by law to consider said r
and
WHEREAS, at said hearing, upon hearing and considering
testimony and arguments, if any, of all persons desiring to
heard, said Commission considered all factors relating to th
Subdivision; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, th
Commission recommends APPROVAL of MS-460 based on the f findings and subject to the following conditions:

3) The proposed subdivision is consistent with all element the city's General Plan, including the land use element designates this site for low-medium density residential
development at 0-4 du/acre.
4) The proposed project will not result in any adverse env
mental impacts and it has been found to be exempt from Carlsbad Environmental Protection Ordinance per Section 19.04.090(C)4, which specifically exempts panhandle lot the R-1 zones in developed areas.
5) The project is consistent with all city public facility policies and ordinances and with Title 21.of the city's
Municipal Code.
Conditions
1) Approval is granted for MS-460 as shown on Exhibit "A" I September 15, 1980, incorporated by reference and on fi
the Planning Department. Development shall occur subst# as shown unless otherwise noted in these conditions.

3) Structures permitted in the access portion of the lot s be limited to mailboxes, fences, trash enclosures, land containers and nameplates. Except for mailboxes, the structure shall not be greater than forty-two inches in
