MICHAEL'S EPISCOPAL CHURCH ON PROPERTY GENERALLY LOCATED ON THE NORTHWEST CORNER OF CARLSBAD BOULEVARD AND CEDAR AVENUE. APPLICANT: ST. MICHAEL'S EPISCOPAL CHURCH CASE NO: 'CUP" 1 8 3 .~ ~~ ~ ~ ~~ ~~~~~~~~ WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, saLd verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Cod the Planning Commission did., on the 8th day of October, 1980, hold a duly noticed to consider said application on property described as: The northwesterly half of Block (7) of the Town of Carlsbad accord-ing to Xap No. 535 file2 on May 2, 1888. WHEEEAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persc desiring to be heard, said Commission considered all factors relating to CUP-183. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoin9 recitations are true and correct.. E) That based on the evidencefpresented at the public heari the Commission recornends APPROVAL, of CUP-183, based or the following findings and subject to the following conditions: Findings: 1) That the Planning Commission has previously found the UE be desirable to the development of the community and PC RES0 #1707 I, - t e e 1 2 3 4 5 6 essentially in harmony with the various elements and obje of the General Plan; in that they have previously approve CUP-39, 2) That this conditional use permit is not detrimental to existing uses or to uses specifically permitted in the zone because the new additions will increase the size of the existing parish hall to the size of the parish hall that was approved by the Planning Commission in 1968. All landscaped areas shall be maintained in a healthy anc thriving condition, free from weeds, trash and debris, Approval of this request shall not excuse compliance with sections of the zoning ordinance and all other applicable city ordinances in effect at time of building permit issuance, In order to provide for fire protection during the constr tion period, the applicant shall maintain passable vehicc access to all buildings. In addition, adequate fire hydr with required fire flows shall be installed on and off si as required by the Fire Department. The applicant shall construct street improvements along the property frontage on Beech Avenue which remains to be completed,within five years from final occupancy of any n buildings or when the adjoining property to the west deve whichever occurs first, These improvements consist of: 4+ feet of pavement, curb and gutter and sidewalk. These improvements shall be constructed to City standards and according to improvement plans prepared by the City of Carlsbad and an agreement for the future improvement s: be recorded prior to obtaining a building permit. The applicant shall enter into a lien contract for the future improvement of Garfield Street based on a half street of 30 feet of right-of-way and 20 feet of pavement including all improvements required by City standards. This agreement shall be recorded prior to obtaining a building permit. The applicant shall install street trees to City speci- fications at 40 foot intervals along the property frontage on Cedar Avenue and Beech Avenue prior to final occupancy of any new buildings. The variety of said trees shall be subject to the approval of the Parks and Recreation Department. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Unless otherwise stated herein, this approval is subject to all applicable conditions of Resolution No. 551, (.CUP-39) incorporated by reference herein a This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Eggineer,-.determines that sewer facilities are available at the time of application such permits and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not available, building permits will not be issued.
