HomeMy WebLinkAbout1980-10-08; Planning Commission; Resolution 1711.c. -2 * e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION mSOLUTION NO. 1711 A RESOLUTION OF THE PLANNING COIMISSION OF THE CITY OF CAP-LSBAD, CALIFORNIA, APPROVING A VARIANC OF SECTIONS 21.18.050(5) & (lo), TO REDUCE THE SIDEYARD SETBACK FROM 9' TO 5' TO ALLOW THE ENCROACHMENT OF PARKING GENERALLY LOCATED ON THE SOUTHEAST CORNER OF PI0 PIC0 DRIVE AND CHESTNUT AVENUE. APPLICANT: FREEHOF CASE NO: V-313 WHEREAS, a verified application for certain property, t wit: Portion of Lots 12 and 13 in Elock 'IC" of the Resubdivi of a portion of Alles Avocado Acres, Map No. 2027. has been filed with the City of Carlsbad, and referred to th Planning Commission; and WHEREAS, said verified application constitutes a reques as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 8th day of October, 1980, hold a duly noticed public hearing as prescri by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consi all testimony and arguments, if any, of all persons desiring .be heard, said Commission considered all factors relating tc V-313 D NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hear the Commission recommends APPROVAL of V-313, based on t following findings: 'Findings: 1) That there are exceptional or extraordinary circumstanc conditions applicable to the property or to the intend€ r?: 0 e 1 2 that do not apply generally to the other property or cll of use in the same vicinity and zone for the reasons st, in the staff report. 3 4 2) 5 6 7 3) a That such variance is necessary for the preservation a enjoyment of a substantial property right possessed by property in the same vicinity and zone but which is den to the property in question for the reasons stated in t staff report. PASSED, APPROVED AND ADOPTED at a regular meeting of th Planning Commission of the City of Carlsbad, California, he1 the 8th day of October, 1980, by the following vote, to wit: AYES: Commissioners Schick, Larson, Rombotis, Marcu: NOES : None.
